Report of Findings
Licensing received a complaint on February 16 and February 18, 2022, regarding care and supervision. The following details were provided:
- The Manager uses inappropriate guidance practices
- Staff restrain children
- Children are not grouped according to schedule E.

All areas of the complaint were fully investigated. Evidence was obtained through interviews and observations. Licensing determined the following contraventions:
Child Care Licensing Regulation (CCLR) section 34 (2)(a) Group sizes and employee to children ratios.
- CCLR section 51(2)(a) Behavioural guidance
- CCLR section 52(1)(b) Harmful actions not permitted
- Community Care and Assisted Living Act (CCALA) Section 7(1)(b)

14020 - CCLR s.34(2)(a)Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: The Group Child Care (30 months to school age) and Group Child Care (under 36 months) programs were mixing.
Corrective action: Corrective action plan received.
14270 - CCLR s.52(1)(b)A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (b) confinement or physical restraint by an employee, except as authorized in a child care's plan if the care plan includes instructions respecting behavioural guidance.
Observation: It was confirmed that children were physically restrained.

14360 - CCALA s.7(1)(b)(i)A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: The health and safety plan put forward by the Manager was not followed
