Report of Findings
Community Care Facilities Licensing [CCFL] received a complaint on August 5, 2020 alleging concerns regarding Care and Supervision.

The allegations included the following details:
- A staff member was heard yelling outside and was observed to hit a child on the back of the head.

All areas of the complaint were fully investigated. Evidence was received and reviewed from video footage of the incident, interviews, an inspection of the physical facility and documentation.

The following contraventions were substantiated:
- Child Care Licensing Regulation (CCLR) Section 51(1)(a) Behavioural Guidance
- CCLR Section 19(2)(b) Staffing Requirements

12110 - CCLR s.19(2)(b)A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (b) has the personality, ability and temperament necessary to manage or work with children.
Observation: Licensing determined the manager's actions did not meet the ability and temperament necessary to manage or work with children.
Corrective action: Corrective action plan required
14220 - CCLR s.51(1)(a)A licensee must (a) ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance.
Observation: Licensing determined that inappropriate behavioural guidance was used.

- Licensee has provided educational training courses for the Manager who remains as a supervised support staff until courses are completed.
