Report of Findings
Licensing received a complaint on June 14, 2021, regarding care and supervision. The following concern was alleged:

-A staff was observed holding a crying child on the ground and yelling at them.

All areas of the complaint were fully investigated. Evidence was collected through interviews and a review of records.

Licensing determined the following contraventions:
-Child Care Licensing Regulation Section 19(3) Character and skill requirements
-Child Care Licensing Regulation Section 52(1)(b)(c) Harmful actions not permitted
-Child Care Licensing Regulation Section 58(2) Care plans
Substantiated Contraventions: Evidence for this summary report is based on a combination of the Licensing Officer’s observations, a review of facility records and information provided by the facility staff at the time of the investigation.

12130 - CCLR s.19(3)Without limiting subsection (2), if the duties of an employee include care for a child who requires extra support, a licensee must ensure that the employee has the training and experience and demonstrates the skills necessary to care for that child.
Observation: CCFL determined staff lacked information on how to implement strategies and provide appropriate care to a child who required extra support.

14270 - CCLR s.52(1)(b)A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (b) confinement or physical restraint by an employee, except as authorized in a child care's plan if the care plan includes instructions respecting behavioural guidance.
Observation: CCFL determined the use of restraints are not in a child's care plan.

14280 - CCLR s.52(1)(c)A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (c) harsh, belittling or degrading treatment by an employee or another child, whether verbal, emotional or physical, that could humiliate the child or undermine the child's self respect.
Observation: CCFL determined a staff used inappropriate guidance methods.

19250 - CCLR s.58(2)(a)The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: CCFL determined a care plan was not developed in conjunction with the child's parent or medical professional.
