Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Foam is exposed on some bed mats in the toddler program making the mats difficult to sanitize.
Corrective Action(s): Please ensure foam is not exposed on the bed mats.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Six staff files were reviewed. One staff file contained an expired criminal record check.
Corrective Action(s): Please ensure all criminal record checks are current.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Six staff files were reviewed. Immunization status was not obtained for one staff.
Corrective Action(s): Please ensure immunization status is available for all staff.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Medication was at the facility although no care plan available for a child requiring extra support.
Corrective Action(s): Please ensure a care plan is available for all children requiring extra support.

RECORDS AND REPORTING: 19230 - CCLR s.58(1)(c)(i) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (c) the resources to be made available to the child requiring extra support by the licensee, including (i) any adaptation of the community care facility necessary to ensure the child's safety or comfort.
Observation: Medication listed in a child’s care plan had expired.
Corrective Action(s): Please ensure all medications listed in a child's care plan has a current expiry date.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: The care plan for two children had not been reviewed annually with the parent or any person requested to by the parent.
Corrective Action(s): Please ensure all care plans are reviewed annually.

Comments

Summary of Inspection
At the inspection dated September 23, 2021 there were 54 children and 12 staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report and the facility risk assessment tool will be emailed to the manager. Total time includes office time.
The following were discussed with the manager:
Ensuring inspection decals are replaced on fire extinguishers during annual inspection.
The intent of Temporary retentions/placements.
Ensuring families are informed before an application for an exemption or temporary retention/placement is submitted to CCFL.
Continuing to follow all Covid-19 protocols.
