Reason for Investigation - Care and supervision
Report of Findings
CCFL received a complaint on July 5, 2019 alleging concerns related to staffing, care & supervision. The following details were provided:
- exceeding the maximum capacity of children
- inadequate employee to child ratio
- unqualified employee caring for children

All areas of the complaint were fully investigated. CCFL conducted interviews & reviewed facility records. Community Care Facilities Licensing (CCFL) determined the following contraventions to the Child Care Licensing Regulation (CCLR):
- CCLR section 19(1)(a) – Character & skill requirements
- CCLR section 19(4)(a) – Character & skill requirements
- CCLR section 39(1) – Continuous supervision required
- CCLR section 56(1)(b) – Community care facility records & policies

Immediate corrective action was taken to address some contraventions. A corrective action plan is required to be submitted. CCFL to conduct follow-up inspection to ensure compliance.

12040 - CCLR s.19(1)(a)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: An employee lacked a valid CRC.
Corrective action: Corrective action plan required.
12140 - CCLR s.19(4)(a)A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: An employee's ECE certificate had not been validated.
Corrective action: Corrected during inspection.
12430 - CCLR s.56(1)(b)A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: An employee lacked current records required under section 19.
Corrective action: Corrective action plan required.
14060 - CCLR s.39(1)A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Licensing determined continuous supervision was not maintained for a brief time.
