Introduction


An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the outdoor play area.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed inside the facility:

-3 tall shelves were not secured to the wall
-plug covers were missing throughout the facility
-cords in the front area were exposed

Corrective Action(s): Please ensure a health and safe environment is provided at all times when children are in attendance

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following was observed in the facility:

-a wall in the washroom had peeling paint
-the floor in the group child care room had chips and a section had exposed concrete
-the wallpaper was peeling off of the wall in the preschool room
-a hole was noted in the door to the washroom
-one electrical plug plate was broken and one was held in place with tape.
Corrective Action(s): Please ensure the facility is clean and in good repair while children are present.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11050 - CCLR s.14(1) - A licensee, other than a licensee who provides a care program described as Family Child Care or Child-minding, must have for each child at least 3.7 m2 of usable floor area in the community care facility, excluding (a) hallways, (b) built in storage areas, (c) bathrooms, and (d) fixed appliances, or, if not fixed, large appliances that are not normally moved from one area to another.
Observation: Licensing observed that the area in the entryway was not being used as an area for the children to play. In reviewing the original floor plans for the facility this area is part of the useable floor space and part of the calculation in the number of children that are licensed for the facility.
Corrective Action(s): Please use the entire floor space that was originally licensed for the children's use.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: During the inspection Licensing observed the following were placed in front of the emergency exit:

-sleep mats
-a bag of garbage
-a broom
-two wooden flooring planks

Corrective Action(s): Please ensure nothing is located in front of the emergency exit or is located next to the emergency exit that may hamper an exit in an emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:

-bathroom cleaner underneath the sink (please complete by May 28, 2019)
-rust on the radiator in the bathroom
Corrective Action(s): Please ensure children do not have access to any object or substance that is hazardous to their health

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing observed two out of three staff records. One staff record was missing a verification of the ECE certificate.
Corrective Action(s): Please ensure ECE certificates are verified using the system established by the ECE registry.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Two staff records of three were reviewed. One staff was missing a site specific criminal record check. In discussion with the Manager she stated that she has applied to share the criminal record check.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: Licensing observed that only some policies and procedures were on site. In discussion with the Manager she stated she did not have the additional policies and procedures.
Corrective Action(s): Please ensure a record of all policies and procedures are located at the facility.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: During the inspection only one towel was noted for drying hands in one of two washrooms
Corrective Action(s): Please ensure single use or individual hand towels are provided for each child in care. This will reduce the spread of cross contamination between children and ensure the health and hygeine of the children in the facility. In discussion with the Manager she stated that she was using tissues for the children's hands. These tissues were not located within easy reach of the washroom.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Twelve children's records of twenty-four were reviewed. One child was missing a record of immunization.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The attendance was observed. Three children were signed in out of seven in attendance for the group child care. In discussion with the Manager she stated that some of the preschool children were attending on the group child care side and were signed in on the preschool side. We discussed the importance of keeping accurate attendance records and not mixing the children in the different care programs.
Corrective Action(s): Please ensure the attendance is complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Twelve children's records of Twenty-four children were reviewed. Two children were missing an emergency contact number and one child was missing a doctor's name and phone number.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19310 - CCLR s.58(3)(e) - The licensee must record compliance with the care plan of a child requiring extra support in respect of each of the following that are applicable to the child: (e) any other matter for which the licensee has agreed with the parent of the child to record compliance.
Observation: Licensing observed the care plans for 3 children at the facility. No record of compliance with the care plans was recorded.
Corrective Action(s): Please ensure a record of compliance with the care plan is completed for each child.

Comments

At the inspection dated May 28, 2019 there were 14 children and 2 staff present. At this inspection the above noted contraventions were identified. Please submit a written response to Licensing by June 11, 2019 outlining how you have corrected the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Temporary Placements
· Active Supervision
· Lead in the Water
