Report of Findings
Licensing received a complaint on March 22, 2023, alleging concerns regarding Staffing.

The following information was provided:
- There are individuals ordinarily present at the facility that are unrelated to the daycare

All areas of the complaint were fully investigated. Evidence was collected through: An interview with the Manager, observations and interviews. Licensing determined the following
contraventions:
- Child Care Licensing Regulation (CCLR) Section 20(1)- Staffing, Criminal record checks.
- CCLR Section 35(2)(a) and (b)- Conducting other business prohibited.
Substantiated Contraventions: Evidence for this summary report is based on a combination of the Licensing Officer’s observations, a review of facility records and information provided by the facility staff at the time of the investigation.
Observed Violations/Contraventions: A summary of the violations found during the complaint investigation are listed below.
Code Category/Description
12160 - CCLR s.20(1)The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Through an interview with the Manager and observations, Licensing determined that six people over 12 who were ordinarily present did not have a criminal record check.
Corrective action: Corrective action plan to be developed and submitted.
14040 - CCLR s.35(2)(a)A licensee must not, while providing a care program, conduct any business or other activity within or from the licensee's personal residence that may (a) interfere with the supervision of children or the space used for the care of children.
Observation: Through an interview with the Manager and observations, Licensing determined that the Licensee was operating a business or permitting a business to operate in the home while operating a licensed family child care.
Corrective action: Corrective action plan to be developed and submitted
14050 - CCLR s.35(2)(b)A licensee must not, while providing a care program, conduct any business or other activity within or from the licensee's personal residence that may (b) threaten the health or safety of children.
Observation: Through an interview with the Manager and observations, Licensing determined that six people were staying at the facility on a temporary rental through AirB&B during the hours the daycare were in operation. Two means of egress lead directly to the daycare and one exit leads directly to the outdoor play area. This may present a potential hazard to the health and safety of children in care.
