Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Licensing observed that the nap room was being used as a bedroom and had a large bed in it. The sleep mats/cots were observed in the play area. The facility was licensed based on the information provided in original floor plans. Licensing was not informed of this change prior to implementation. Children in a family childcare are required to have access to a bedroom as outlined in the Director of Licensing Standards of Practice.
Corrective Action(s): Please ensure that the designated nap room is being used for the children in care. If any changes are made to the original floor plans licensing must be notified prior to this change for approval.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection Licensing observed a temporary table with a heavy pot filled with food on the top of the table. The table was in the middle of the play area. This could present a falling hazard.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: During the inspection an easel was observed next to the fire exit. The fire exit door could not be completely opened.
Corrective Action(s): Please ensure to not store anything next to the emergency exit that could block or hamper an exit in case of an emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection Licensing observed that a cupboard door in the kitchen was unlocked. The cupboard contained bottles of bleach, and several cleaning products. This was at the children's level.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to the health and safety of children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: The hot water was measured during the inspection. The temperature was 53.7 degrees Celsius. This is a repeat contravention from inspection # CLAN-CC5NW2. Please provide active supervision until this is corrected.
Corrective Action(s): Please ensure the water temperature does not exceed 49 degrees Celsius to comply with the legislation.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the inspection Licensing observed the following:
- The fire extinguisher was not in the facility. In discussion with the Licensee she stated it was in the garage.
-Diapers were missing from the emergency kit. Adding diapers to the emergency kit was discussed at the previous inspection.
Corrective Action(s): Please ensure you have the necesary supplies and a fire extinguisher to be prepared in case of an emergency.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed the attendance records for the month of February. Three departure times were missing and one child was not signed in on the attendance record. The Licensee stated that it was the child's second day at the facility.
Corrective Action(s): Please ensure the attendance records are complete and ensure each child who is present at the facility has an attendance record.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: During the inspection the children's records were reviewed. One child in attendance was missing their record. The Licensee confirmed that the child was only attending part time and this was her second day at the facility. The serious risk to the child's safety was discussed with the Licensee.
Corrective Action(s): Please ensure children's records are completed prior to starting care at the facility and that the records are onsite.

Comments

At the inspection dated February 7, 2023 there were 1 practicum, student and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by February 21, 2023 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Licensee.

The following was discussed:
-The reportable incident reporting procedure.
-The current cleaning protocols that are in place
-Placing children in highchairs only for eating purposes.
