Report of Findings
Licensing received a complaint on January 5, 2023, alleging concerns regarding Staffing and Care and Supervision.

The following information was received:

Staffing:
-Staff do not have qualifications to work in the IHMA facility.

Care and Supervision:
-Nap area is in use by a family member during nap time.
-The complainant has observed more than 8 children in care.

All areas of the complaint were fully investigated. Evidence for analysis was obtained through interview and review of facility attendance records, staff schedules and staff files.
Licensing determined the following contraventions.
-Child Care Licensing Regulation (CCLR) Section 34(1)
-CCLR Section 34(2)(a)
-Child Care and Assisted Living Act (CCALA) Section 7(1)(b)(i)

14010 - CCLR s.34(1)A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Licensing determined that employees did not have the qualifications necessary to meet the needs of children in care.

14020 - CCLR s.34(2)(a)Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing determined groups at the child care facility were not divided as per Schedule E.

50050 - CCALA s.7(1)(b)(i)A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care.
Observation: Licensing determined the nap room was being used by a family member while children were in care, in contrast to the policy set out by the Licensee.
