Licensing received a complaint on December 06, 2023 regarding:
- Care and supervision
- Program

All areas of the complaint were fully investigated. Evidence was obtained through interviews and observations.

The following was confirmed:
- Screen time policy was not followed according to the facility's policy.
- Daily outdoor play was not being offered according to the program of activities.
- Staff files were incomplete.

Licensing determined the following sections of the Child Care Licensing Regulations were contravened:
Section 19 (1)(a)(b)(d) and 19(4)(a) - Character and skill requirements.
Section 21(1) - Continuing health of licensees and employees.
Section 44(1)(a),(3)(4)(5) - Program of activities.
Substantiated Contraventions: Evidence for this summary report is based on a combination of the Licensing Officer’s observations, a review of facility records and information provided by the facility staff at the time of the investigation.

12040 - CCLR s.19(1)(a)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Review of 2 staff files noted the criminal record check was not obtained for 1 staff.
Corrective action: Please ensure staff files are complete.
12050 - CCLR s.19(1)(b)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Review of 2 staff files noted 1 did not have a minimum of 2 character references.
Corrective action: Please ensure staff files are complete.
12070 - CCLR s.19(1)(d)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Review of 2 staff files noted 1 did not have a valid educator's certificate.
Corrective action: Please ensure staff files are complete.
12140 - CCLR s.19(4)(a)A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Review of 2 staff files noted there were no certificate validations.
Corrective action: Please ensure staff files are complete.
12170 - CCLR s.21(1)A licensee must not continue to employ a person in a community care facility unless the licensee has evidence that the person continues to comply with the Province's immunization and tuberculosis control programs.
Observation: Review of 2 staff files noted there were no record of the staff having immunization status.
Corrective action: Please ensure staff files are complete.
18010 - CCLR s.44(1)(a)A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (a) is designed for the development and care of children.
Observation: The manager confirmed that the screen was on where a child was napping.
Corrective action: Please ensure to follow your screen time policy.
18060 - CCLR s.44(3)(4)(5)A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: The manager confirmed that they did not go for a walk or play outdoors in the last 2 days. LO discussed the importance of outdoor play.
Corrective action: Please ensure children are provided with the opportunity for daily outdoor active play.
