Report of Findings
Licensing received a complaint on December 16, 2022, regarding care and supervision, records and reporting, and hygiene and communicable disease control. The following details were provided:
- Staff to child ratios are not being followed
- Children not supervised at all times
- The Manager uses inappropriate guidance
- A child received injury from an employee

All areas of the complaint were fully investigated. Evidence was obtained through interviews and observations. Licensing determined the following contraventions:
- Child Care Licensing Regulation (CCLR) section 15(1)(b) Furniture, equipment, and fixtures
- CCLR section 19 (1) (a)(b)(f) Character and skill requirement
- CCLR section 19 (5) (a)(b)(c) Character and skill requirement
- CCLR section 34 (2) (b) Group sizes and employee to children ratios

Observed Violations/Contraventions: A summary of the violations found during the complaint investigation are listed below.

11090 - CCLR s.15(1)(b)A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: The emergency exit was blocked and hampered.
Corrective action: Corrective action plan required.
12040 - CCLR s.19(1)(a)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: An employee did not have a completed criminal record check obtained.
Corrective action: Corrective action plan required.
12050 - CCLR s.19(1)(b)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: The facility did not obtain a copy of an employees character references

12090 - CCLR s.19(1)(f)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two employees.
Corrective action: Corrective action plan required
12151 - CCLR s.19(5)(a)Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check was not obtained for one or more volunteers.

12152 - CCLR s.19(5)(b)Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one or more volunteers.
