Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager is not posted.
Corrective Action(s): Please ensure the name of the manager is posted in the facility.

STAFFING: 12030 - CCALA s.7(1)(a) - A licensee must do all of the following: (a) employ at a community care facility only persons of good character who meet the standards for employees specified in the regulations.
Observation: A staff file was not available for one person working at the facility during this inspection. The manager called the facility during this inspection and confirmed that this staff is a family member and does not have a staff file.
Corrective Action(s): All staff must be fully screened and have a full staff file available before they start to work at the facility.
Date to be Corrected: Before this person works at the facility again.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Proof of verification of references was not available for one staff person.
Corrective Action(s): Please ensure that staff references are checked and proof of this is available.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Proof of validation of an ECE certificate was not available for one staff person.
Corrective Action(s): Please ensure all ECE and ECEA certificates are validated through the ECE Registry.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: A staff person present during this inspection was replacing an ECE staff. This person stated they were taking their ECEA courses but do not have their certificate yet. The minimum requirements of a staff person replacing an ECE is an ECEA therefore the staffing requirements of the Child Care Licensing Regulation are not being met.
Corrective Action(s): Please ensure that staffing meets the requirements of Schedule E CCLR including Section 37 Absent employees.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: A medication authorization form for a child stated the medication is to be given "as needed". There are no specific instructions letting staff know when to give the medication.
Corrective Action(s): Please ensure that there are specific instructions directing staff when to administer medication to a child. Staff were able to describe symptoms the child would display when the medication had to be administered.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for 10 children were reviewed. A medical insurance plan number (Care Card number) was not available for three children and immunization status was not available for two children.
Corrective Action(s): Please ensure all children files contain a medical insurance plan number and immunization status.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for 10 children were reviewed. The name and contact information for a doctor (or walk in medical clinic) and for an emergency contact person was not available for three children.
Corrective Action(s): Please ensure that all children's files contain contact information for a doctor or medical clinic and an emergency contact person.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: Files for two children who no longer attend the facility were reviewed. The last day of care was not available in these files.
Corrective Action(s): Please ensure the date on which a child stops attending the facility is recorded.

Comments

Summary of Inspection
At the inspection dated March 15, 2022 there were six children and two staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the ECE staff person and written off site. A copy of this report was hand delivered to the facility on March 15, 2022. The Licensing Officers business card was provided.
The following recommendations were discussed:
Information for registered children is kept on three forms. It is recommended that the manager use the Fraser Health Child Registration form for ease of access to the information.
Covid protocols are still to be followed. It is recommend that a window be opened in the facility to allow the flow of fresh air.
