Introduction

An unscheduled follow-up inspection to the routine inspection #AFUN-BE7TXD dated July 18, 2019 was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). The Licensing Officer (LO) reviewed the contraventions previously observed for compliance during today's inspection.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: Tripping hazard has been temporarily resolved. The damaged storage bin has been removed. The resilient surfacing under the slide has yet to be addressed. The Licensee has submitted some details of the renovations on the outdoor play area that will address some of the previous contraventions. The slide/climber structure has been relocated to an area near a large tree. This area poses a risk to the children playing on the structure as it is within the fall zone of a large tree. The staff relayed that the climber / slide is not being used at this time. LO encouraged staff to make the climber ladder and slide inaccessible while the renovations are underway as it currently is accessible to the children playing in the area. LO additionally discussed with staff that a plan or drawing of the proposed redesigned outdoor play space would need to be submitted to ensure safety concerns are addressed prior to proceeding with the renovation on the outdoor play area.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A staff working in the program has yet to receive a facility specific CRC. The application was submitted July 16/19 and staff relayed that it will be followed up on soon.
Corrective Action(s): Ensure all staff have valid CRC results that are facility specific.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Thirteen children were in attendance during the inspection. Twelve children were recorded on the attendance document. LO discussed the practice of accurate attendance records with the staff during the inspection.

Summary of Inspection
On the inspection date of August 13, 2019 there were 13 children and 3 staff present. At this inspection the contraventions identified during the routine inspection were confirmed to have been corrected with the exception of the contraventions identified on this inspection report.
