Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All eight care categories were assessed for compliance.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing inspected two staff files and noted that one did not have evidence of ECE certificate validation.
Corrective Action(s): Ensure all staff certificates are validated using the system maintained by the early childhood educator registry and that there is evidence of said validation.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child who requires an Epi Pen on site does not have a care plan developed in consultation with the parent or any person requested by the parent. Licensing notes that although a care plan was not present, the facility did have permission to administer medication.
Corrective Action(s): Ensure that care plans are developed in consultation with parents/persons requested for children who require extra support.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation (CORRECTED DURING INSPECTION): Licensing noted one child's care plan was not dated, which is required for the purposes of annual review.
Corrective Action(s): Ensure all care plan are dated so that annual review is possible.

Comments

Summary of Inspection:
At the inspection dated February 2, 2022, there were 8 children in care with 2 educators.
A COVID-19 Risk Screening was conducted before the inspection.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
This report was written off site and is unsigned due to COVID-19 safety practices. The contraventions identified in the report were reviewed with the Manager before Licensing's departure.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed. A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
Dicsussion items:
-Discussed the requirement for posting manager's name at the facility.
-There is a climbable bench in the facility's outdoor play space next to the a fenced area. A clarifying conversation with the manager indicated that the children do not climb on to the bench and that it is used for sitting. The manager has committed to ensuring the bench is not used as a way for children to climb over the fence. The use of the bench will be monitored as the group changes and enrollment grows.
