Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Files for two staff were reviewed. Immunization status was not available in one file.
Corrective Action(s): Please ensure immunization status is available for all staff.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Monthly fire drills were not recorded from February - May 2021. The manager stated the drills had taken place and described the fire drill procedure.
Corrective Action(s): Please ensure all fire drills are recorded.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At the time of this inspection seven children were present. The second staff person is qualified as an Early Childhood Assistant. The second staff person needs to be qualified as an Early childhood Educator.
Corrective Action(s): Please ensure staffing is in compliance with Schedule E at all times. The Manager stated she will apply for a staffing exemption to bring the facility into compliance.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Files for eight children were reviewed. Parent contracts were not available in four files. The manager stated she is waiting for families to return the contracts for the files.
Corrective Action(s): Please ensure parent contracts are available in all files.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for eight children were reviewed. An MSP number was missing in one file.
Corrective Action(s): Please ensure an MSP number is available for all children.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Files for eight children were reviewed. The date of enrolment was missing in four files.
Corrective Action(s): Please ensure all children's files have the start date recorded.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The Licensing Officer reviewed time in/out records for June 2021. Time out was not recorded for some children on several days.
Corrective Action(s): Please ensure time out is recorded each day.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for eight children were reviewed. Contact information for an emergency contact person was missing in three files and the phone number of a doctor was missing in one file.
Corrective Action(s): Please ensure contact information for an emergency pick up person and the phone number for a doctor is available for all children.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Files for eight children were reviewed. Permission to call a doctor or ambulance was not available in one file.
Corrective Action(s): Please ensure all files have permission to call a doctor or ambulance.

Comments

Summary of Inspection
At the inspection dated June 15, 2021 there were seven children and three staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager and at the request of the manager a copy will be mailed to the facility. Total time in this report includes office time.
The following were discussed with the manager:

Keeping a record of then an ECE or ECEA certificate is verified.
