Introduction

The licensing officer (LO) conducted an unscheduled routine inspection of this community care facility (CCF) to assess compliance w/ the:
• Community Care & Assisted Living Act (CCALA)
• Child Care Licensing Regulation (CCLR)
• Director of Licensing Standards of Practice (DLSP; Active Play, Family Child Care, & Safe Play Space)

At the time of inspection, evidence for this facility inspection report (FIR) was based upon:
• the LO's
- observations
- review of the CCF's records
• information provided to the LO by the licensee

The LO reviewed these 10 areas today:
• licensing • physical facility • staffing
• policies & procedures • care & supervision • hygiene & communicable disease control
• medication • nutrition & food services • program
• records & reporting

As part of this inspection, the LO completed & provided a risk assessment tool, which includes:
• any noncompliance identified
• the CCF's compliance & operational history since 11/Sep/2015

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name wasn't posted.
Corrective Action(s): The licensee must ensure that the manager's name is posted conspicuously.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: 1) Adjacent to the kitchen, 2 tall shelves that are > 4' aren't secured to the wall.
2) In the outdoor play space, the stairs leading up to the deck was accessible.
3) In the main play space, there are some sharp shelving corners from toy storage that are @ children's height.
Corrective Action(s): The licensee must ensure that
1) These shelves are secured to the wall.
2) Children don't have access to the stairs.
3) Children don't have access to these sharp corners.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: 1) Toilet plungers & a toilet brush were on the ground adjacent to the toilet.
2) In the outdoor play place, a bramble bush w/ thorns was easily accessible to children.
3) In the outdoor play space, the detached garage's door wasn't locked.
Corrective Action(s): The licensee must ensure that children don't have access to any hazardous objects or substances.

1) Was corrected in the LO's presence.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: An ordinarily present individual > 12 years lacked a valid CRC.
Corrective Action(s): The licensee must obtain a CRC for all ordinarily present individuals > 12 years.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The licensee's last documented fire drill system practice was in Feb/2018. She was unaware of the requirement to practice these monthly.
Corrective Action(s): The licensee must ensure that fire drill system implementation is practiced monthly.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): k) Multi-Age CC, incl. none under 12 mo. - Maximum group size is 8, having no more than 3 children younger than 36 mo.

There were currently 4 children in care; all under 36 months. There's no temporary placement on file.
Corrective Action(s): The LO printed a temporary placement application & schedule for the licensee to complete, which she did in the LO's presence. The LO printed the approval form today.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: A child lacked his immmunization status.
Corrective Action(s): The licensee must ensure that all requirements of s. 57 are obtained by children's 1st day of care.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Yesterday's departure times & today's arrival times weren't documented.
Corrective Action(s): The licensee must ensure that children are signed:
- in immediately upon arrival
- out immediately upon departure

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 1 child lacked a medical practitioner's contact information. The licensee stated that the child doesn't currently have a family Dr.
Corrective Action(s): The licensee must ensure that this field isn't left blank. A walk-in clinic or hospital the family would use would be acceptable.

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: The licensee wasn't aware of the requirement to document inspections (daily, monthly, & annual), maintenance, & repairs pertaining to the outdoor play space.
Corrective Action(s): The licensee must ensure that the abovementioned items are documented as prescribed.

Comments

The CCALA, CCLR, & the DLSP set the minimum standards that must be met by all licensed CCFs to ensure the health & safety of all vulnerable individuals in care. The onus rests w/ the licensee to provide for the health & safety of all the children in their care @ all times.

Continuous, active supervision (s. 39 of the CCLR)
The LO discussed how the licensee must ensure that:
• children are actively supervised @ all times by ≥ 1 responsible adult while maintaining the minimum employee to children ratio @ all times
• employees practice active supervision via a combination of close proximity & attention, watching, & listening, while being able to move through & see the entire space that children are in

Notification of illness or injury (s. 55 of the CCLR)
The LO discussed how the licensee must notify:
• a parent or emergency contact immediately after the child becomes ill, injured, or is (possibly) involved in a reportable incident (RI) while in care
• the LO within 24 hrs after a child is (possibly) involved in an RI while in care
- this requirement can be satisfied via email, phone, or fax
- in the LO's absence, please report to the duty LO via the Population Public Health Central Call Centre (604.587.3936)
- please deliver the yellow copy of the completed RI form to the nearest Health Protection office

Safe drinking water (s. 48 of the CCLR)
Recent testing in many communities has shown higher concentrations in tap water than previously expected. The LO discussed the importance of flushing pipes by running the cold water tap, as per the provided BC Govt Fact Sheet (CCLR, CCALA): Lead in Drinking Water.
