Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: An exposed electrical outlet was accessible to children.
Corrective Action(s): Please ensure children do not have access to electrical outlets.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check was not obtained for two volunteers. One volunteer had a copy of a criminal record check although it had not been obtained through the sharing program of the CRRA. The manager said both volunteers have applied for their criminal record checks.
Corrective Action(s): Please ensure all volunteers have a valid criminal record check before they are present at the facility.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for two volunteers.
Corrective Action(s): Please ensure reference checks are available for all volunteers.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two volunteers.
Corrective Action(s): Please ensure immunization status is available for all volunteers.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: 10 children's files were reviewed. a parent contract was not available in eight files.
Corrective Action(s): Please ensure proof of a parent contract is available for all children.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 10 children files were reviewed. A medical insurance number was missing in one file and immunization status was not available in two files.
Corrective Action(s): Please ensure all children's files contain the required information.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 10 children's files were reviewed. Contact information for a doctor was not available in one file and an emergency contact was not available in one file.
Corrective Action(s): Please ensure all the required information is available in children files.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 10 children's files were reviewed. A photograph was not available for two children.
Corrective Action(s): Please ensure a photograph is available for all children.

Comments

Summary of Inspection
At the inspection dated August 8, 2022 there were eight children, one staff and two volunteers present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
The following were discussed with the manager:
The use of sun hats and sunscreen during outdoor play.
Ensuring a staff person is in the nap room at all times the fan is being used.
Not storing staffs personal belongings where they are accessible to children.
Holding children by the hands not the wrists.
Children picked up after school are counted as part of the number of children in care.
A transportation policy needs to be developed if before and after school care is provided.
The nutrition policy needs to be updated if the facility serves lunch.
