Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During the inspection licensing observed that the sink in the washroom had paint chips and the wood was exposed. This could be difficult to clean and disinfect. This is a repeat contravention from inspection # CLAN-BHNR4A.
Corrective Action(s): Please ensure the facility is in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed the following outside the emergency exit: a ladder, chairs, a bag of soil and two folding tables propped up against the fence. This is a repeat contravention from inspection # CLAN-B8RQGH and # CLAN-BHNR4A
Corrective Action(s): Please ensure the emergency exit is not blocked with furniture, equipment and supplies to ensure it is clear in the event of an emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed rust at the bottom of the outdoor lower chain fence. This is a repeat contravention from inspection #CLAN-BUUTCJ. Please provide active supervision in the outdoor area until this is completed.
Corrective Action(s): Please ensure children do not have access to any objects or substances that are hazardous to their health and safety.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed the staff records. One staff record was missing character references.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one employee.
Corrective Action(s): Please ensure the staff records are complete.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: In reviewing the facility records, the emergency plan was not recorded. In discussion with the Manager she stated the facility did not practice or record the emergency plan.
Corrective Action(s): Please ensure the emergency plan is completed annually and recorded.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: A care plan was observed for the facility. A child's emergency medication was expired and there was no permission to administer medication for an additional emergency medication.
Corrective Action(s): Please ensure emergency medication is not expired to comply with the care plan and that permission to administer emergency medication is received.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: In discussion with the Manager she stated that the children play outside three times per week.
Corrective Action(s): Please ensure children play outside on a daily basis to comply with the legislation.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Five children's records were reviewed. One child's record was missing a medical practitioners name and phone number. One child's record was missing a medical practitioners' phone number and one record was missing an emergency contact.
Corrective Action(s): Please ensure children's records are complete.

Comments

At the inspection dated February 9, 2022 there were 17 children, and 2 staff, 1 student and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by February 23, 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following education/recommendations were provided:

-The reportable incident reporting procedure and forms.
-The current COVID-19 protocols that are in place

The inspection findings were reviewed with the Manager at the inspection. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office. The report was written in .75 hours and this is not included in the report. A copy of these documents were sent to the Manager. If you have any questions regarding this report please contact me.
