Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the former Manager was posted in the facility. This is a repeat contravention from inspection #CALAN-CU4PD4
Corrective Action(s): Please ensure to remove the previous Manager's name and post the new Manager's name in the facility

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed in the outdoor play area:
-Stairs leading to the back gate had a small gate at the bottom of the stairs that was not affixed on either side. Large gaps were observed on both sides of the gate. This is a repeat contravention from inspection #CLAN-CU4PD4, #CLAN-CMYS7Y, #CLAN-CKZSTJ, CLAN-C9VQEX.
-A pool used for water play was turned over and the children were jumping on the pool. Licensing recommended the pool be put away if it was not in use.
-A shed had a wooden ramp that was slippery. Several children were observed slipping on the wooden ramp
-A broken plastic bin was observed. This had sharp edges.
Corrective Action(s): Please ensure to complete a playground check prior to playing outside to identify and remove any hazards.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed the emergency exit was blocked by sleep mats.
Corrective Action(s): Please keep all exits clear in case of emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection Licensing observed the following under the sink in the washroom:
-A large bottle of concentrated bleach
-Various chemical cleaning products
This is a repeat contravention from inspections: #CLAN-CMYS7Y, #CLAN-CKZSJT, #CLAN-BYXSYK
-A staff bag was within easy reach of the children.
-A door was easy to open. Behind the door were paint cans and a chemical fertilizer
-Rust was observed on the edges of the sink
Corrective Action(s): Please ensure that children do not have access to any objects or substances that may be hazardous to their health and safety. Please remove hazardous items.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: The staff records were reviewed. One staff was missing character references.
Corrective Action(s): Please ensure all documentation for staff is obtained prior to their start date.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one employee.
Corrective Action(s): Please ensure all documentation for staff is obtained prior to their start date.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee.
Corrective Action(s): Please ensure all documentation for staff is obtained prior to their start date.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: One staff record was observed. The certificate was not verified. This is a repeat contravention from inspection #CLAN-CKZSJT
and #CLAN-BYXSYK-
Corrective Action(s): Please ensure all documentation for staff is obtained prior to their start date.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: In discussion with the Manager it was determined that the emergency plan was not practiced or recorded. This is a repeat contravention from inspection #CLAN-CU4PD4
Corrective Action(s): Please ensure to practice and record the emergency plan drill once a year.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the inspection a fire extinguisher was not observed in the classroom
Corrective Action(s): Please ensure you have a fire extinguisher to be prepared in case of an emergency.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Licensing observed that the Manager's ECE certificate expired November 7th, 2023. In discussion the Manager has applied for renewal. An additional staff, who has their ECEA certificate, works at the facility 3 days per week. The daycare is open 5 days per week.
Corrective Action(s): Please ensure to apply for ECE renewal prior to certificate expiry dates. Please ensure adequate staffing to meet the legislative requirements are in place

PROGRAM: 18030 - CCLR s.44(1)(c) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (c) complies with the program standards set out in Schedule G.
Observation: During the inspection insufficient toys and materials were observed inside the facility and in the outdoor play area. Eight children were present in the facility. Children were observed running throughout the facility and pushing furniture.
Corrective Action(s): In discussion with the Manager she stated the Director was intending to purchase more toys but had not done so yet. This was discussed at the previous inspection. Please ensure to have sufficient toys for a variety of age groups.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed the children's records. Two records were missing an MSP number. This is a repeat contravention from inspection #CLAN-CU4PD4,
Corrective Action(s): Please ensure children's records are complete. Prior to starting at the facility.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Two newly registered children's records were reviewed. Two children were missing the name of a medical practitioner and the name of an emergency contact. Not having the name of a medical practitioner is a repeat contravention from inspections: #
CLAN-CU4PD4 and #CLAN-CKZSJT
Corrective Action(s): Please ensure children's records are completed prior to starting at the facility.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Two new children's records were reviewed. Two records were missing a photograph
Corrective Action(s): Please ensure children's records are completed prior to starting at the facility.

Comments

At the inspection dated March 11, 2024 there were 8 children, 1 staff and the Manager was present. At this inspection the above noted contravention was identified. Please correct the above noted contravention by March 26, 2024, unless other wise specified in this report. Please submit a written response to Licensing by March 26, 2024 stating how you have corrected the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

The following was discussed with the Manager:
· Reportable Incidents
· Lead in the water
· Removing items from the first aid kit with a drug identification number. Written permission from a parent or guardian is required prior to application.
· Adding a CPR mask to the first aid kit
