Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10120 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation (CORRECTED DURING INSPECTION): Upon Licensing's arrival, there were 24 children present in one of the 30 months to school age program that is licensed for a max capacity of 22 children.
Corrective Action(s): Please ensure max capacities are not exceeded in any of the programs.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION):

Licensing observed the following:

> An electrical cord hanging down at the children's level in one of the 30 months to school age programs. The cord was removed during the inspection;
> A fire extinguisher on the ground, next to the children's sleeping mats in one of the under 36 months programs. This was addressed during the inspection;
> Toys stored on higher shelves in the under 36 months programs. Some of the toys were close to the edge of the shelf. These toys were removed during the inspection.
Corrective Action(s): Please ensure a healthy and safe environment at all times while children are in care.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: One of the 30 months to school age programs did not maintain a record of their fire drill conducted in May.
Corrective Action(s): Please ensure a record of monthly fire drills.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At the time of the inspection, one of the under 36 months program was operating with a ratio of one ECE and one responsible adult to 6 children. As per Schedule E, the room should have been staffed with one ITE and one ECE.
Corrective Action(s): Please ensure appropriate staffing qualifications when scheduling staff.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: Licensing observed that a child's medication expired in February 2021. The staff member advised that the parent was going to bring non-expired medication by the end of the day.
Corrective Action(s): Please ensure valid medication.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: At the time of the inspection, there were 24 children in one of the 30 months to school age program but this was not reflected on the attendance record for that room. Some children's names were signed on the attendance record for the room they would eventually go into.
Corrective Action(s): Please ensure an accurate attendance record to reflect the numbers of children present in each program.

RECORDS AND REPORTING: 19130 - CCLR s.57(2)(g) - A licensee must keep, for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury].
Observation: Multiple rooms were missing records of parent notifications.
Corrective Action(s): Please maintain records of when parents were notified of any injury or illness involving their child while attending the facility.

Comments

At this inspection, the above noted contraventions were identified and dates for correction was provided. Licensing is requesting a written response by June 28, 2021 advising on how the manager will ensure compliance with coded item numbers 14030, 19130, 19090, 10120 and 16020.

As part of this Routine Inspection, a Facility Risk Assessment Tool was completed.

The information contained in the report was discussed with the manager and the report and risk assessment were written off-site. Licensing advised that copies of the report and risk assessment would be emailed to the facility.

Licensing will return for a follow up inspection.
