Introduction

An unannounced routine inspection was conducted today to asses compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance. This is the facility's first routine inspection.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The Licensing Officer noted the facility licence is posted however the name of the Manager is not.

Corrective Action(s): Ensure the name of the Manager is posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The Licensing Officer engaged in a conversation with the facility staff regarding missing fence panels in the children's outdoor play space. Staff have placed chairs in front of the missing panels to prevent children from accessing the neighbouring property. Staff report the missing panels occurred this week.

Corrective Action(s): The Manager has inform staff the fence will be repaired over the weekend (June 8, 2019). Ensure the fence is secured and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: The Licensing Officer observed children playing on the climber/slide piece of equipment located on grass in the outdoor play space. Any item over 18" high to be used by the children must be placed on resilient ground cover. This item was previously brought to the Manager's attention on November 6, 2018 on facility inspection report #KSEY-B69PPF. The Manager stated this piece of equipment will be removed or resilient ground cover would be installed.
Corrective Action(s): Children must not use this item until the Manager has addressed the issue of resilient ground cover. A written response is requested from the Manager to the Licensing Officer as outlining how they will correct this violation.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): During the inspection the Licensing Officer observed child safety locks on the cupboards located under the bathroom and kitchen sinks however they were not secured. The Licensing Officer saw a contained of disinfectant wipes in the bathroom and bottles of liquid soap in the kitchen.

Corrective Action(s): Ensure the child safety locks are secured or remove any hazardous items in a manner that the children cannot access. The locks were secured during the inspection.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: The Licensing Officer reviewed 2 staff files during the inspection and both files contained references for the staff. Upon review of the references one individual's reference were not related to working with children. This individual has prior work experience with children and completed various practicums with children.

Corrective Action(s): Ensure individual's reference are relevant to the work being hired for (example: work with children).

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed two staff files and in one file there was no evidence the Manager or Licensee verified the individuals certificate issued by the ECE Registry.

Corrective Action(s): Ensure all staff's certificates issued by the ECE Registry have been verified and a copy is placed in the individuals file.

At the inspection dated, June 6, 2019 there were 2 staff and 6 children present.
