Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA), the Child Care Licensing Regulations(CCLR) and the relevant Director of Licensing Standards of Practice(DOLSOP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager was not posted onsite.
Corrective Action(s): Please ensure that manager's name is posted in a prominent place within the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: LO observed and discussed the following with the manager:
- 1 toddler classroom uses designated cotton towels per child, per day. If cotton towels are used, please ensure that single-use towels are available after each hand washing.
- cleaning supply was accessible to children in PS/OSC room ( under the washroom sink).
Corrective Action(s): Please ensure that a healthy and safe environment is provided while children are in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check on file is not site specific for 2 staff members.
Corrective Action(s): Please ensure that staff files are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for 2 staff members.
Corrective Action(s): Please ensure staff files are complete.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Staff to Child ratio was not maintained in 1 toddler's room.
Corrective Action(s): Please ensure that staff to child ratio is maintained at all times as per Schedule E of CCLR.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 30 children's files were reviewed; 4 children's MSP number were missing.
Corrective Action(s): Please ensure that all children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 30 children's files were reviewed; 6 children's Dr's information were missing.
Corrective Action(s): Please ensure that all children's files are complete.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Four care plans were not reviewed annually with the parents of the children requiring extra support.
Corrective Action(s): Please ensure that all care plans are reviewed with the parents at least once a year.

Comments

On the inspection date of December 2, 2021 there were 70 children and 16 staff present. At this inspection the above noted contraventions were identified and the Licensee is required to take corrective action to bring the facility into compliance and submit a written response by below date for Licensing to review. The contravention noted in this report was reviewed with the Manager during and after inspection (via phone). As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is attached.

The following were discussed with the Manager:
- Ensure that enough emergency supplies are available at the facility; it is recommended that facility is prepared to respond for minimum of 72 hrs.
- Playground log: to keep a regular log for inspections, repair and maintenance of outdoor equipment.
