Introduction

An unscheduled follow up inspection to the Routine Inspection # JMIA-B26MX4 dated June 28, 2018 was conducted. Areas of non-compliance identified at the last Routine Inspection were reviewed for compliance.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing notes the following;
Outside-
-There are stacked furniture stored within reach of children (potential to be pulled down on a child).
- overgrown weeds (dandelions)
- fungus growing on gate at the bottom of the stairs
Inside:
- One crib is broken (although currently only being used to store items)
- Storage of a single metal bedframe (entrapment hazard underneath)
-Excess storage of non daycare items in the nap room (including a metal curtain rod and another unused bed).
- Portable Heater stored under the pile of unused beds
Corrective Action(s): Please ensure a safe environment including facility to be in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: The fence panels have a temporary wire fence placed on it, however it doesn't provide an age appropriate enclosure to ensure the safety of the children. There are other fence panels that are loose or detached.
The Licensee had emailed Licensing, regarding a compliance plan (which wasn't received by licensing). The plan included not using the backyard until September 28, 2018 and accessing a local park with walks in the area.
This is a repeat contravention.
Corrective Action(s): Please provide a compliance plan for the fixing of the fence and include a play space away plan in full details.
Date to be Corrected: Sunday September 16, 2018 - written plan.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The active play and screen use policy that were due to be created by July 4, 2018 (as noted on the last routine inspection) have not been addressed.
This is a repeat contravention.
Corrective Action(s): Please ensure these two new policies are created, implimention and provided to parents no later that September 16, 2018

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed the attendance records and notes the following;
- There are a number of dates where children were not signed out (departure times were not noted) for example June 29 and July 5th.
There was no information documented regarding absents of children
At the routine inspection Licensing provided education around the intent of the requirement of attendance and required the Licensee to start documenting attendance records on a single daily sheet (a sample was provided). This hasn't been put in place.
Corrective Action(s): Please ensure that attendance records are on one page and arrival, departure and any absents are recorded.

Comments

During today’s inspection the Licensee, another individual and 3 children were on site.

Licensing notes that it appears that the some of the previously identified contraventions have been addressed as follows:
· Healthy and Safe Environment including-
o Backyard- rusted furniture has been removed
o Inside- Bulletin board secured to wall

Other information;
- Paper towels were not available in the washroom when licensing first inspected the washroom, Licensing notes that after 20 minutes an individual living in the home, brought a roll of paper towel to the washroom.
- Licensing made a mistake when referencing a Drop down crib, it appears to have potentially been the broken crib (see contravention)

Discussions held today include:
- Importance of communication with and responding to Licensing in an appropriate time period
- The use of small toys/pieces was discussed - when infants/toddlers are in care
- Active and Positive Supervision
- Lead in pipes- each morning “flush taps” for about 5 minutes
- Reportable Incident Reporting –to ensure you have notified Licensing within 24 hours. If you cannot reach your LO, please contact the Duty Line- 604-587-3936
