Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the applicable Director of Licensing Standards of Practice. All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Growing in the adjacent yard is a cottonwood tree which has grown over the fence and has several branches hanging into the child care yard. During recent windstorms and inclement weather various branches and debris from the tree has fallen into the child care yard. There are presently branches which appear dead and potentially poses a hazard to anyone using the child care yard.
Corrective Action(s): The overhanging branches and potential dead branches are to be addressed so as to prevent them from falling on individuals using the outdoor space.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing saw a brown, child sized chair located at the east side of the main activity room that is beginning to show signs of wear. Once the material is completely worn away the chair will no longer be cleanable as it will be porous.
Corrective Action(s): The chair will need to be removed, repaired or replaced.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: The two emergency doors from the main activity room have been secured with a wooden bar.
Corrective Action(s): Remove the wooden bar on the door and implement a different system to secure the doors when not on site.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing noted containers of hand sanitizer, within children's reach, in various places within the child care facility. While outdoors licensing observed staff with hot beverages which were left within easy access of the children.
Corrective Action(s): As per the manufacturer's recommendation hand sanitizer must be kept out of children's reach. Ensure all hand sanitizer is stored accordingly. In order to prevent a child from being inadvertently scalded all hot beverages must be kept out of children's reach including those in 'travel mugs'.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon review of 4 staff files one file had an expired criminal record clearance letter and one file had a criminal record clearance letter addressed to a different employer/agency. Both of these items were previously contravened on August 12, 2020 as noted on the last routine inspection report #MPEE-BSERYQ.
Corrective Action(s): The one staff showed licensing they had applied to renew their criminal record check but was unsuccessful. The Licensee indicated that they experienced challenges with the processing for the renewal and sharing results for their staff. Licensing discussed with the Licensee the importance of ensuring they follow through in obtaining current criminal record clearances for their staff. The Licensee said they would address this issue within the next day.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon review of 5 staff files two files did not contain current validation of the individual's early childhood education certificate. This item was previously contravened on August 12, 2020 as noted on the routine inspection report #MPEE-BSERYQ.
Corrective Action(s): Validation of staff's early childhood education certificate must be conducted upon hire of new staff, or when a certificate and has been initially issued or upon renewal of an existing certificate.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Licensee maintains a log of fire and emergency drills however there were no fire drills entered for August or September 2021. There has been no entry for an emergency drill for the past 12 months. The Licensee stated these were all done however it wasn't recorded. Licensing suggested recording these items in a different manner such as the daily attendance sheet and not on a separate sheet of paper to streamline the recording process.
Corrective Action(s): Implement and maintain a recording system for both fire (monthly) and emergency (annually) drills.

Comments

At the inspection dated October 12, 2021 there were 15 children and 7 staff (practicum student, support staff as well as regular staff) present. At this inspection the above noted contraventions were identified and any action required by the Licensee is included. As part of this routine inspection a Facility Risk Assessment Tool is completed. Due to the current COVID-19 pandemic the routine inspection report and facility risk assessment tool were completed off site and copies were sent to the Licensee. This report was reviewed with the Licensee at the time of the inspection.

The BC Centre for Disease Control information sheet "When to Get Tested for COVID-19" was discussed with the Licensee. A copy of the document was sent to the Licensee.

Licensing discussed with the Licensee the volume of equipment and supplies that has been acquired over the years. The Licensee has stored these items both outdoors, and indoors (in storage rooms, nap area and the main activity space). Licensing acknowledges the facility has limited storage and the facility would benefit from a general clean up. The Licensee must ensure that any items are stored in safe manner and does not take away the usable floor space as outlined in the the Child Care Licensing Regulation.
