Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following were observed during the inspection: Exposed drywall throughout the facility and Little Tykes equipment in need of cleaning in the yard.
Corrective Action(s): Please ensure that children do not have access to drywall and that all outdoor equipment is cleaned.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check for one staff has been applied for although the results have not been received.
Corrective Action(s): Please ensure a criminal record check is available for all staff before they start work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two references have not been verified for a staff member. The manager said she had verified one reference although there was no evidence to support this.
Corrective Action(s): Please ensure a minimum of two references are verified and proof of verification is available before staff start work.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for a staff person.
Corrective Action(s): Please ensure all staff have a current resume on file before they start work.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Evidence of a staff ECE Certificate was not available. The manager said she had verified the certificate although there was no evidence to support this.
Corrective Action(s): Please ensure ECE Certificates are verified and evidence of the verification is available before a staff starts work.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The manager said a fire drill had not been conducted in October.
Corrective Action(s): Please ensure a fire drill is conducted every month.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: On inspection the Licensing Officer observed expired food in the emergency supply kit and not enough supplies for 72 hours.
Corrective Action(s): Please ensure there are enough emergency supplies for all children for up to 72 hours and that all supplies have a current expiration date.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation (CORRECTED DURING INSPECTION): Single use towels were not available in the children's bathroom. The manager provided paper towels during this inspection.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Files for nine children were reviewed. A parent contract was not available for two children.
Corrective Action(s): Please ensure a parent contract is available for all children.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for nine children were reviewed. One file did not have contact information for a doctor or medical clinic. The Licensing Officer recommended working with the family to ensure a plan is in place to obtain this information.
Corrective Action(s): Please ensure a doctor or medical clinic information is available for all children.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: A care plan including the course of action recommended by health care professionals for a child requiring additional support is not available for one child.
Corrective Action(s): Please ensure a written care plan is available for all children requiring additional support.

Comments

Summary of Inspection
At the inspection dated November 14, 2022 there were six children and two staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
The following were discussed with the manager:
Ensuring a School Age drop off and pick up policy that guides staff needs to be in place before this service is offered to families.
Cleaning bottles need to be accurately labelled with the contents.
If creams such as Paneten are used parents need to give written permission.
If a staff person is left alone with children they must be fully screened (including first aid).
Asking the Licensing Officer if there are any questions about the facility operations.
