Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following during today's inspection:
- Stapler was accessible to infant and toddlers in the multi age. Staff removed it during inspection.
-In the infant and toddler nap room items are stored on the wall shelving that could potentially fall off these shelves in the event of an earthquake. This is a repeat contravention from the last routine inspection # SMIA-CH8MDQ dated 11 August 2022.
-Wooden shelf in the multi age room was unsecured to the wall.
- In the infant and toddler room - Edges of foam climbing blocks and a bean bag chair is showing signs of wear and tear and cannot be sanitized effectively.
-Lower slats of the blinds in the infant and toddler playroom and nap room are bent and are accessible to children.
Corrective Action(s): A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 5 staff files. 2 files were missing character references and evidence of reference being checked. Manager said that she did verify them but did not make a note of it.
Corrective Action(s): Please ensure that character references are obtained and verified for each employee before they start employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two staff. Manager obtained immunization status for one staff during inspection.
Corrective Action(s): Please ensure staff files are complete.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation (CORRECTED DURING INSPECTION): In the infant and toddler room fire drill was conducted in September 2023 but had not been recorded. Staff corrected this during inspection.
Corrective Action(s): Please ensure that fire and emergency drills are documented

Comments

At the inspection dated October 13, 2023, there were twenty two children, six staff and the manager present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by October 16, 2023 stating how the identified contraventions will be addressed to ensure year-round compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:
Safe food storage – Children perishable lunches and snack to be stored between 0-4 degrees Celsius
Appropriate cover for the outdoor sandbox to prevent animals accessing the sand when sandbox is not in use
Storage of toys and equipment in a way that does not pose a risk to children in an event of an earthquake.

The inspection report was written on-site and details were reviewed with the Manager prior to writing the report. A copy of the follow up to routine inspection report and risk assessment is provided to the manager at this inspection.
