Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Residential Care Regulation (RCR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #MMAE-ANRT5H have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 31200 - RCR s.19(3) - If a licensee installs electronic devices for the purposes of transmitting or recording images of persons in care or members of the public, the licensee must display in a prominent place notice that electronic surveillance is being used.
Observation (CORRECTED DURING INSPECTION): Inspection of the facility determined that cameras were located at the facility which are transmitting images of persons in care and members of the public to video screens located in secure areas.
Corrective Action(s): Ensure that there is notification prominently displayed that identifies that electronic surveillance is being used.

CARE AND/OR SUPERVISION: 34900 - RCR s.83(5)(a) - If a person in care refuses or is unable to be weighed, the licensee must (a) record in the nutrition plan of the person in care the reason why the person in care was not weighed.
Observation: Review of 2 of 5 person in care (PIC) care plans found that weights were missing. One PIC was missing weights from February, April, June of 2018 and the second PIC was missing weights from February, March, April, and June. Discussion with the Manager and Staff determined that staff has difficulty weighing these PIC's as they may refuse but there is a process in place to determine if weight loss has occurred and when the staff need to refer to a health practitioner for further consultation.
Corrective Action(s): Ensure that if a PIC is unable to be weighed, that a reason is documented why the PIC as unable to be weighed.

RECORDS AND REPORTING: 39410 - RCR s.86(a) - A licensee must keep the following records in respect of each employee: (a) criminal record check results,.
Observation: Review of 2 of 5 staff files found that one staff file had no record of a completed Criminal Record Check (CRC) and one staff's CRC had expired,
Corrective Action(s): Ensure that employee records are complete.

RECORDS AND REPORTING: 39430 - RCR s.86(c) - A licensee must keep the following records in respect of each employee: (c) compliance with the Province's immunization and tuberculosis control programs.
Observation: Review of 1 of 5 staff files found no documentation of compliance with the Province's tuberculosis program.
Corrective Action(s): Ensure that employee file are complete.

RECORDS AND REPORTING: 39440 - RCR s.86(d) - A licensee must keep the following records in respect of each employee: (d) a record of any performance reviews made under section 40 [continuing monitoring of employees] and any attendance at continuing education programs.
Observation: Review of 5 staff files found no record of a complete performance evaluation.
Corrective Action(s): Ensure that employee records are complete.
