Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager was not posted
Corrective Action(s): Ensure that the name of the Manager is posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: It was observed that there were many areas with paint chipping and gyprock exposed.
Corrective Action(s): Ensure that the facility is clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation (CORRECTED DURING INSPECTION): A high chair was blocking the emergency exit to the front door. The high chair was moved during the inspection.
Corrective Action(s): Ensure that the emergency exit is not blocked.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The door leading to the garage where tools and cars are stored was unlocked, however child safe door handle was on the door. There is concern that older children will be able to open the child safe door handle and access the garage area.
A razor was located in the shower stall in the children's bathroom, accessible to children.
Corrective Action(s): Ensure that the children do not have any access to objects or substances that may be hazardous.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 1 of 2 staff did not have a current criminal record check.
Corrective Action(s): Ensure that each staff has a current criminal record check.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 1 person living in the home over the age of 12 did not have a current criminal record check.
Corrective Action(s): Ensure that each person ordinarily present on the premise has a current criminal record check.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: 2 medications were observed without the amount to be given or time to be administered.
Corrective Action(s): Ensure that any medication agreed to be administered has the time and amount to be given.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 1 or 5 children's files reviewed did not have the name or phone number of the medical practitioner and 1 of 5 children's files did not contain the name or telephone number of the emergency contact.
Corrective Action(s): Ensure that each child has a record of medical practitioner and emergency contact.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: 1 child requiring a care plan did not have one created.
Corrective Action(s): Ensure that each child requiring a care plan has one created.

Comments

Summary of Inspection
At the inspection dated February 16, 2021 there were 5 children and 2 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Staff to child ratios
· Medications
· Active Supervision
