Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Name of manager was not observed to be posted within the facility
Corrective Action(s): please ensure the name of the manager is posted in a prominent place within the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): Large container of cleaning solution stored on a shelf which was not wide enough to support the container , risk that it may fall causing injury.
Corrective Action(s): The container was removed to a secure location during the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: Highchair is not equipped with straps and is consists of worn material.Discussed importance of ensuring children are secured when seated in highchairs to prevent risk of injury. A box of recycling is located beneath the chair adding increased risk should a child access this causing the chair to fall.
Corrective Action(s): ensure equipment and furnishings are free from hazards , safe and used as intended to prevent risk of injury.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: a wooden landscape barrier is positioned at the bottom of a Little Tykes slide , a garden shed has been removed from the yard with now hazards were the shed once stood :
Wire protruding from the house at eye level, unstable cement foundation , a drop in surfacing to an area below.( used to be behind the shed. Licensee included supervision prevents children from accessing this area.
Corrective Action(s): please ensure children have access to areas of the yard which are safe and ready for use, supervision alone will not ensure children do not access the area. Ensure lower yard is made inaccessible in order to reduce risk of injury

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Hazards observed within the facility and accessible to children :
extended electrical cords and plastic sheet located in a lower level kitchen cabinet , and plastic bag on the washroom floor.
These items were removed and secured during the inspection

Corrective Action(s): please ensure a system is developed to self identify safe storage practices and to ensure children do not have access to any item or object that may be hazardous to their health and or safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensee has employee a staff who was present at the facility and does not hold a Criminal Record Check. It is noted that this is a repeated contravention as identified during a previous inspection. Licensee working alongside the staff who is used as a helper.
Corrective Action(s): please provide within your response Feb 27, 2019 your plan to ensure staff are fully screened with the required documentation prior to employment

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References ( names and contact information ) provided for a staff employed within the facility however there is no record to demonstrate that the references have been contacted.
Corrective Action(s): please ensure a system is developed to capture staff screening requirements including reference checks.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation (CORRECTED DURING INSPECTION): Licensee holds a valid ECE Certificate however the verification system has not be implemented. The licensee stated she was not aware of this step and completed the validation process during the inspection.
Corrective Action(s): please ensure system of screening is complete for staff to include the verification process as established by the director of the ECE registry.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Fire drills found to be recorded with exception to December 2018.
Corrective Action(s): please ensure a system is developed to capture monthly documentation and implementation of fire drills.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Observation 1 - staff assisted 2 children with blowing their noses handwashing did not occur (used Kleenex was placed on the window ledge) , the staff then handled children's food.
Observation 2 - a child used the washroom , handwashing did not occur , staff did not assist or provide reminders to wash.
Corrective Action(s): ensure a system is developed to instruct children and staff through hygiene practices in order to reduce spread of illness and promote a healthy environment.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: medication stored on site is inaccessible to children however is consents are not completed in full , missing details such as date and times. Expired medication is also stored on site. this is observed to be a repeated contravention.
Corrective Action(s): Ensure medication administration procedures and current.consent forms to be completed in full to prevent risk of medication error. Expired or discontinued medication should be returned and or discarded.

Comments

Summary of Inspection
At the inspection dated Feb 26,2019 there were 7 children and 2 staff present. At this inspection the above noted contraventions were identified. Licensee to provide a written response by March 6, 2019 identifying how the contraventions have been addressed , Licensing will confirm receipt of the response email. Due to the number of contraventions with some repeated from previous inspections a follow up inspection will occur.Licensee corrected contraventions as they were brought forward , the importance of being proactive and regularly self monitoring was reviewed.
Discussed current cleaning product - ensure contact time and instructions for use are being appropriately followed. some products require a 10 min contact time and a clear rinse to be effective.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
