Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing noted the name of the new appointed manager is not displayed.
Corrective Action(s): Ensure the name of the manager is displayed in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following in the outdoor play area:
- A Geodome does not have sufficient resilient surfacing around it. The manager stated the landscaper moved the geodome from the grass area to the wood chips when they were cutting the grass.
- A wooden indoor play kitchen is stored in the unused sandbox area. The kitchen is starting to fall apart and mold is growing on the back.
Corrective Action(s): Ensure a healthy and safe environment is provided at all times.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A selection of staff files were reviewed. Out of the 3 files reviewed, a minimum of two character references were not obtained for 3 employees.
Corrective Action(s): Ensure a record of the employees character references in on file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A selection of staff files were reviewed. Out of the 3 files reviewed, a record of the person's work history was not obtained for 2 employees.
Corrective Action(s): Ensure a record of the person's work history is on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A selection of staff files were reviewed. Out of the 3 files reviewed, immunization status was not obtained for one employee.
Corrective Action(s): Ensure there is evidence that employees have complied with the Province's immunization and tuberculosis program.

Comments

Summary of Inspection:
At the inspection dated March 3, 2022 there were 11 children in care with a staff, the Manager and a Student.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by March 10, 2022 .
Actions required by Licensing include reviewing the written response.

The following education was provided:
Covid-19 vaccine status for staff
The documentation in the log book was missing key information. Licensing discussed the use of the log book and to ensure when documenting to include the 5 W's (Who, what, where, when, why and sometimes how).
The emergency exit was covered with a curtain. Licensing informed the manager that the door can only be covered during nap time as this was an emergency exit.
Replenish all first aid kits
The emergency supplies appear sufficient for 50% of the children. Licensing informed the manager that there should be sufficient supplies in place for all children and staff to respond to and recover from any emergency.
The sandbox is currently not in use and it appears it is being used for storing toys. The manager stated due to Covid-19 they discontinued the use of the sandbox. Licensing informed the manager as per the guidelines set out by the BC CDC objects made of materials that are not easily cleaned can continue to be used.
Licensing observed 2 children arguing in the kitchen area. A staff member pulled a child towards them by tugging on the back of a child's sweater and re-directed the child to another activity. No further conversation occurred. Licensing discussed this guidance strategy with the staff and they stated that due to the children arguing over toys prior to Licensings arrival, the staff felt it was appropriate to re-direct the child to another activity before the situation escalated. Licensing discussed that this would not be an appropriate guidance strategy and that the staff could have used other methods that were more developmentally appropriate. Licensing suggested to the manager and licensee contact all staff should review the Behavior Guidance policy. Licensing will also provide additional resources.
Licensing noted a sibling group who are new to Canada and do not have a care card. In discussion with the manager it was suggested that the family provide any other form of health insurance coverage in the event the children are required emergency services.

This report was written off site and a copy of both the report and Risk Assessment was emailed to the facility. This report is unsigned due to health and safety practices during COVID-19.
