Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The Manager's name was not posted in the facility
Corrective Action(s): Please ensure the Manager's name is posted in a prominent place.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed that two staff certificates were not posted in the facility. This is a repeat contravention from inspection #CLAN-BCDPQD
Corrective Action(s): Please ensure staff certificates are posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following:
-The sink in the washroom is chipped. This is a repeat contravention from inspection # CLAN-BCDPQD
-Paint chips in the cubby area. This is a repeat contravention from inspection #CLAN-BCDPQD
-The cabinet doors under the sink are showing signs of wear.
-The sandbox cover was rough and may cause a potential for splinters.
Corrective Action(s): Please ensure the facility is in good repair.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Two staff records of three were reviewed. One staff record was missing references.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for two employees.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee. This is a repeat contravention from inspection #CLAN-BCDPQD

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Two staff records of three were observed. Two staff records did not have a verification for a certificate. This is a repeat contravention from inspections #CLAN-BCDPQD and # CLAN-BY4QRL

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: During the inspection licensing reviewed the policies. There was no policy outlining how prepayment will be returned if a family leaves the facility. This may happen when parents prepay by cheque. This is a repeat contravention from inspection #CLAN-BY5QRL and #CLAN-B5KV4G.
Corrective Action(s): Please ensure the repayment policy is complete.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Six children's records were reviewed. One child's record was missing their immunization status.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed six children's records. Two children's records were missing a date of enrollment. This is a repeat contravention from inspection #CLAN-B5KV4G
Corrective Action(s): Please ensure children's records are complete.

Comments

At the inspection dated February 17, 2022 there were 11 children, and 2 staff, 2 parent volunteers and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by March 3 , 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following education/recommendations were provided:

-The reportable incident reporting procedure
-The current COVID-19 protocols that are in place
-Please ensure both toilets and sinks are accessible to children to remain in compliance
-Contents in the first aid kit were reviewed. Items with a Drug identification number (DIN) are required to have signed permission from a parent prior to application.
-Please ensure first aid kits are replenished with a triangular bandage and a mask for CPR.
-Please post a list of allergies.

The inspection findings were reviewed with the Manager at the inspection. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office. The report was written in .75 hours and this is not included in the report. A copy of these documents were sent to the Manager. If you have any questions regarding this report please contact me.
