Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection, Licensing observed a box of toys and a hand bag on the diapering changing surface. Manager explained that the diapering surface is only used for changing diaper; only today things were placed on it.
Corrective Action(s): A licensee must ensure that the diapering changing surface is only used for diaper changes and not for placing items on it.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During inspection Licensing observed the following:
-Several cobwebs hanging from the nap room ceiling & visible cracks in one corner of the nap room ceiling.
-Broken climber in the outdoor play area
-Peeling paint on the lower portion of the bathroom walls on the side of the toilet.
Corrective Action(s): A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: During inspection of the outdoor play area Licensing observed:
-An opening between the shed and the wooden fence is used to store a ladder horizontally. Licensing was concerned that this could lead to a potential entrapment.
-To prevent younger children from climbing onto the staircase, the lower steps must be inaccessible from the side.
Corrective Action(s): Please ensure that the outdoor play space is fully enclosed to ensure children are free of harm.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: At the time of this inspection, there were 5 children under the age of 48 months. For Family Child Care, Child Care Licensing
Regulation permits 4 children under 48 months. Temporary retention process was discussed.
Corrective Action(s): Ensure compliance with Schedule E of the Child Care Licensing Regulation.

Comments

At the inspection dated May 12, 2023 there were seven children and the Manager present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by May 15, 2023. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following was discussed with the Manager:
Covered container for soiled diapers
Valid CRC are available, expiry dates were reviewed
Temporary retention process
Photographs of children are stored on a cell phone. It is recommended that hard copies of photos are available in case the cell phone does not work.
Manager requested the routine inspection report and risk assessment to be emailed. The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on May 12, 2023.
