Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #LPEN-ASESC5 have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager is not posted.
Corrective Action(s): Please post the name of the Manager

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following observations were made:
- 4 electrical sockets in the main play area were uncovered and accessible to children.
- a small tree had been cut at the trunk but in the backyard play area and was dangling from the larger tree. The Manager stated that the branches were stuck. There is a potential for the smaller tree to fall if children were moving it or if there is a strong wind. The Manager stated that she will ask her husband to remove the smaller tree.
Corrective Action(s): Please ensure that children do not have access to uncovered electrical sockets.
Please remove the small tree that is dangling from the branches of the larger tree.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 2 of 3 ECE certificates did not have a validation for the current ECE certificate.
Corrective Action(s): Please ensure that each ECE or ECEA certificate is validated by the system established and maintained by the ECE registry.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 1 of 3 persons living on premise did not have a criminal record check available. The Manager stated she thinks it was completed last year.
Corrective Action(s): Ensure that each person over 12 years of age ordinarily present on the premise has a current criminal record check.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: 1 of 3 staff files was not available for review. 1 of 2 files reviewed did not contain a valid criminal record check.
Corrective Action(s): Please ensure that all staff files are current and available for review.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Manager stated that fire drills and emergency drills were completed but that they did not keep a record of when they completed them.
Corrective Action(s): Please ensure that a record of compliance with section 22(2)(b) and (c) is kept.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: 1 month of attendance records were reviewed and 4 times children did not have arrival times documented and 1 time a child did not have time of departure documented.
Corrective Action(s): Please ensure that arrival and departure times are documented for each child.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 4 of 6 children's files reviewed contained photos of children when they were much younger and could not be used to readily identify the children. The Manager stated that she will take a picture of the older children.
Corrective Action(s): Please ensure that a photograph or digital image to readily identify a child is available for each child.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: 1 child requiring life saving medication did not have a care plan available.
Corrective Action(s): Please develop with the parent of the child a care plan with information set out in CCLR s.58

Comments

A discussion with the Manager was had regarding the number of children who can be in care at any one time. The facility is currently licensed as a Multi-Age facility and can have a maximum of 8 children in care. The Licensing officer explained that the transfer of care happens when the employee picks the child up from school. The Manager will schedule children according to schedule E.
