Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: One area of the facility had stripped paint exposing part of the wall.
Corrective Action(s): Please ensure that the facility is in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: The plastic lid of a toy storage bin was broken in one area producing sharp edges.
Corrective Action(s): Please ensure that all equipment is in good repair and free of hazards.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following hazards have been observed; 2 long wood pieces with rusted nails sticking out of two different garbage bins in the backyard area, pieces of broken tiles along one side of the house in the rock area, broken metal planter type wiring along the other side of the house, medication stored openly in the fridge.
Corrective Action(s): Please ensure that hazardous objects are inaccessible to children in care

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff's criminal record check (CRC) had expired last year. RCMP has been done for this year. Licensee was aware that regardless of a RCMP check a new CRC was required from Victoria.
Corrective Action(s): Please ensure that a CRC is done for all staff.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: One staff is missing a resume.
Corrective Action(s): Please ensure that all staff have a resume on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Two staff have not had verification of their ECE certificate.
Corrective Action(s): Please ensure that all staff have verified their ECE certificate by the ECE registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Several granola bars, one bottle of water and 2 juice boxes were noted in the emergency backpack. Manager stated that she had supplies based on the current enrollment.
Corrective Action(s): Please ensure that there is sufficient amount of supplies available in case of a emergency for the 8 children in care.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: No attendance sheets for September and on several days couple of children were not signed out.
Corrective Action(s): Please ensure that daily attendance is maintained on a regular basis.
Date to be Corrected: As required

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation (CORRECTED DURING INSPECTION): Upon review of 4 children's files, one was missing doctor's phone number.
Corrective Action(s): Please ensure that all children's records are complete.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Child's yearly review of care plan has not been conducted. Licensee has stated that this child has not been in care for 6 months and has requested the parents to provide an updated care plan.
Corrective Action(s): Although child has not attended for 6 months, as this child is still in care care plans need to be reviewed or updated yearly.

Comments

On today's routine inspection the following were discussed with the manager;
-outdoor log of inspection be done as needed
-replenishing outdoor toys and an outdoor toy bin for storage
-medication will be stored in a cupboard that is inaccessible to the children
-how she ensures active supervision at all times
-flushing of water for at least 5 minutes every morning to let out any lead
-ensuring that reportable incidents are reported directly to a licensing officer
Observed the manager being supportive when welcoming a new child entering the program in the morning.

Please provide a written response to how the above coded violations will be addressed to licensing by September 28, 2018.
