Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following hygiene concerns:

> Although they wear gloves, staff from one of the IT programs only use hand sanitizer to clean hands after diapering;
> In one of the IT programs, the children's water bottles were stored on top of each other. Licensing expressed concerns about the transfer of germs because the lids were touching.
Corrective Action(s): Please ensure a healthy and safe environment is maintained at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 4 staff files and observed that although valid, 3 criminal record check clearance letters (CRC) were not referenced to the facility.The manager advised that the sharing process has been initiated.
Corrective Action(s): Please ensure CRC's are appropriately referenced.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 4 staff files and observed the following:

> Record of 2 character references was missing for the manager;
> Record of 1 character reference was missing for one staff.
Corrective Action(s): Please obtain, from each staff prior to hiring, record of character references.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Licensing reviewed 4 staff files and observed that record of a resume was missing for the manager.
Corrective Action(s): Please obtain, from each staff prior to hiring, a record of their work history.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 4 staff files and observed that one staff was missing evidence that they complied with the Provinces immunization and T.B control programs.
Corrective Action(s): Please obtain, from each staff prior to hiring, evidence that they complied with the Provinces immunization and T.B control programs.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 4 staff files and observed that record of certificate verification was missing for one staff.
Corrective Action(s): Please verify staff certificates using the system established and maintained by the director of the ECE registry.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: The following has been identified in regards to staff to child ratios:

> An ECE Assistant has been working alone in one of the 30 months to school age program without an approved staffing exemption from Licensing;
> An ECE has been working alone in the infant program without an approved staffing exemption from Licensing.
Licensing discussed compliance options.
Corrective Action(s): Please ensure appropriate staff to child ratios at all times.

Comments

At this inspection, the above noted contraventions were identified. Licensing provided dates for compliance and and is requesting a written response by May 27, 2021, advising how coded item numbers 14030 and 11010 have been addressed.

As part of this Routine Inspection, a Facility Risk Assessment Tool was completed.

The following was discussed:

· COVID-19 prevention strategies
· Staffing
· Essential service workers registrations


The information contained in the report was discussed with the manager and the report and risk assessment were written off-site. Licensing advised that copies of the report and risk assessment would be emailed to the facility.
