Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: All outdoor play equipment and a high chair on the deck need cleaning. This is repeat non-compliance and was noted on routine inspection #JKIM-BRBTDX dated July 8, 2020.
Corrective Action(s): Please ensure all furniture and equipment are clean.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Cleaning products and cosmetics were accessible to children in the bathroom. A bottle of liquid iron supplement was accessible to children on the deck. Adult vitamins were accessible to children in the dining area of the home. Hazardous substances being accessible to children is a repeat non-compliance and was noted on routine inspection #KSEY-BD3P4D dated June 12, 2019 and routine inspection #JKIM-BRBTDX dated July 8, 2020.
Corrective Action(s): Please ensure children do not have access so any hazardous substances.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A valid criminal record check for a person who lives part time at this address expired in August 2020.
Corrective Action(s): Please ensure a valid criminal record check obtained through the Criminal Record Review Program is available for this person.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The Licensee stated that there is no food in the emergency kit as it expired and has not been replaced.
Corrective Action(s): Please ensure there are enough emergency supplies for all of the children for up to 72 hours.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: There was no record of a fire drill for November 2021. The Licensee stated the drill took place but had not been recorded.
Corrective Action(s): Please ensure all fire drills are recorded.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation (CORRECTED DURING INSPECTION): Liquid soap was not available in the bathroom. The Licensee replaced this during the inspection.
Corrective Action(s): Please ensure liquid soap is available to children at all times.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Five children's files were reviewed. The file for one child did not contain a complete enrolment date.
Corrective Action(s): Please ensure the date of enrolment is available for all children.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Time of arrival and departure for children has not been recorded since November 16, 2021.
Corrective Action(s): Please ensure that arrival and departure are recorded for each child every day.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Five children's files were reviewed. Contact information for a medical practitioner and emergency contact was not available for one child.
Corrective Action(s): Please ensure that contact information for a medical practitioner/medical clinic and emergency contact is available for all children.

Comments

Summary of Inspection
At the inspection dated December 13, 2021 there were three children and one staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager. Total time includes office time.
The following were discussed with the licensee:
Two cats live in the home. A pet policy is to be included in the facility policy package.
To avoid the wood surface of the deck becoming slippery a yearly maintenance schedule is recommended.
If a child's file states the child needs medication and that medication is no loner required the file needs to be updated.
The licensee now has an ECE Certificate. The application process to amend the facility care type to In-Home Multi-Age care was explained.
