Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection. The following areas were reviewed:
· Licensing, Physical Facility, Staffing, Policies and Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting.
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11360 - DLSOP Safe Play Space (ground surfacing [b1]) - [bullet 1] Equipment must not be installed over concrete, asphalt or other hard surfaces.
Observation: A new swing set and slide climber has been built in the backyard. Currently the equipment is on the concrete patio and the slide leads onto the grass. Neither grass or concrete are appropriate ground surfacing for this climber/swing set.
Corrective Action(s): Please ensure that appropriate ground covering is installed under this equipment. Please refer to the Safe Play Standards of Practise for depth and clearance space around the equipment. In the meantime, please make this equipment inaccessible to the children.
Date to be Corrected: Inaccessible immediately and a plan provided for ground surfacing by June 14, 2016.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: One staff is missing immunization status.
Corrective Action(s): Please ensure all staff records are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications].
Observation: One staff who may work alone with the children has an expired Early Childhood Educator licence to practise.
Corrective Action(s): Please ensure that all staff that work alone with the children have a valid licence to practise.
Date to be Corrected: June 3, 2016

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: One staff member who may work alone with the children has an expired first aid certificate.
Corrective Action(s): Please ensure children have access to staff that have valid first aid at all times.
Date to be Corrected: June 3, 2016


Comments

The following was observed today:

-One staff with a valid Early Childhood Educator (ECE) licence to practise present with 7 children
-Children involved in circle time, art activities, outdoor play time

Discussion with staff regarding:

-Requirements for outdoor play equipment
-5210 Resources provided

The following is noted:

-Of the 6 staff that may work at this facility, 4 staff's ECE licence to practise will be expiring within the next 6 months. Please ensure renewals are applied for in sufficient time before the current ones expire. Processing time at the ECE Registry could take up to 6-8 weeks. One staff's licence to practise will expire June 4, 2016.
2 staff's First Aid licence will expire within the next 5 months. Please ensure they are renewed prior to the current ones expiring.
