Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following;
- In the outdoor play climber and slide structure has a slide down pole that children use. At the bottom of the pole there is no resilient surfacing and raised cement around the pole (to secure the pole to ground).
- Two slides on the outdoor play climber and slide structure that don't have sufficient resilient surfacing at the bottom.
Both are potentials for child hurting themselves when coming down either the pole or slide.
- One outdoor plastic bike broken at the bottom close to the pedal and another plastic tractor tire broken.
- The spiral slide in the outdoor play climber and slide structure has some plastic material to cover up the shipped areas. However, the plastic material is also now chipped leaving sharp edges. Potential for a child to cut themselves.
Corrective Action(s): Ensure that a safe and healthy environment is provided at all times to children in care.
Date to be Corrected: June 28, 2021.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following accessible to children in care:
- A Lysol wipes container on a shelf in the same room the children were having snack.
- A Large board on the ground in the outdoor play area. The edges of the board were chipped. The Manager removed the board.
- In one of the bathrooms there was a perfume bottle in an unlocked cupboard. The Manager removed the perfume bottle.
- An unlocked cupboard in the kitchen with a container full of different sunscreen bottles. Licensing observed a child open the cupboard and take the bottle out.
Corrective Action(s): Ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Date to be Corrected: June 18, 2021.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon a review of three staff records Licensing observed one staff's record missing a criminal record check (CRC). The Manager informed Licensing that a CRC for the staff has been applied for.
Corrective Action(s): Ensure that staff records are complete prior to the staff working at the community care facility.
Date to be Corrected: June 30, 2021.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon a review of three staff records, Licensing observed that two staff's certificates have not been validated through the early childhood educator registry. The Manager was unaware that certificates need to be validated every time a new and updated certificate is received.
Education provided.
Corrective Action(s): Ensure that staff files are complete prior to the staff working at the community care facility.
Date to be Corrected: June 18, 2021.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Upon a random review of five children's records, Licensing observed two children's records missing immunization status.
Corrective Action(s): Ensure that children's records are complete prior to the children attending the community care facility.
Date to be Corrected: June 21, 2021.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon a review of the attendance records for the month of June, Licensing observed the following;
- three days that children's time of departure was missing
-two days that children were not identified as present or absent.
Corrective Action(s): Ensure that attendance records are accurate on a daily basis.
Date to be Corrected: June 17, 2021.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Upon a random review of five children's records, Licensing observed one child missing a photograph or digital image.
Corrective Action(s): Ensure that children's records are complete prior to the child attending the community care facility.
Date to be Corrected: June 18, 2021.


Comments

Summary of Inspection
At the routine inspection conducted on June 17, 2021, there were 19 children, two staff and the Manager present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
The following education/recommendations were provided:
Health checks
Cleaning and maintenance of outdoor equipment and toys.
bathrooms; allowing children to use toilet paper on their own to learn autonomy and independence.
The contents of the inspection report was reviewed with the Manager at the time of the inspection. This report was written off site ( .75 hrs ) due to Covid-19 to help promote health and hygiene. A copy of this report and the risk assessment was emailed to the facility.
