Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager is not posted.
Corrective Action(s): Please ensure the name of the manager is posted.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: ECE certificates are not posted for three staff. The senior educator said staff are in the process of posting the certificates.
Corrective Action(s): Please ensure ECE and ECEA certificates are posted for all staff.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During this inspection CCFL noted the following:
Areas behind the toilets are in need of cleaning.
A shelf in the bathroom is covered in dust and is in need of cleaning.
A toilet tank cover is cracked and needs to be repaired or replace.
One toilet seat is stained and is in need or cleaning or replacing.
Areas of dry wall are exposed throughout the facility.
Corrective Action(s): Please ensure all areas of the facility are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: A wooden slat on the climbing structure in the outdoor play area has exposed slivers.
Corrective Action(s): Please ensure children do not have access to slivers on the climbing structure.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Evidence of a valid criminal record check was not available for three staff.
Corrective Action(s): Please ensure evidence of a valid criminal record check is available for all staff.

Observation: Evidence of a resume being obtained was not obtained for three staff.
Corrective Action(s): Please ensure evidence of a resume being obtained is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Evidence of immunization status being obtained for three employees was not available.
Corrective Action(s): Please ensure evidence of immunization status is available for all staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Evidence of certificates being validated by the ECE Registry was not available for three staff.
Corrective Action(s): Please ensure evidence of all certificates being validated by the ECE registry is available.

Comments

Summary of Inspection
At the inspection dated September 21, 2023 there were eighteen children and four staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the senior educator and a copy provided.
The following were discussed:
Storing medications in an unlocked box.
Maintaining loose hinges on a cupboard under the art sink.
If there is a change of facility manager informing CCFL in a timely manner.
