Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References have not been obtained for two of the three staff files .
Corrective Action(s): Ensure a system is developed to capture staff screening requirements including reference checks.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Tow of the three files reviewed did not include the copy of the staff resume.
Corrective Action(s): Ensure that the copy of the resume is obtained and included in the staff files.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: One of the three staff files reviewed showed that the certificate was not obtained and included in the file.
Corrective Action(s): Ensure that the copies of certificate is obtained and included in the file prior to the employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: One of the three staff files reviewed showed that the immunization status was not obtatined.
Corrective Action(s): Ensure staff screening and required documentation is complete priro to the employment and is inclded in the file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Staff certificate was not validated/verified by the system maintained by the early childhood educator registry.
Corrective Action(s): Ensure that the certificate is validated and the copy of the validation is included in the staff file.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Of 5 children's records reviewed,one did not include the date of enrolment.
Corrective Action(s): Please ensure to keep for each child a record showing the date of enrolment in the community care facility.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: One of the children's files had a medical practitioner's phone number and the emergency contact information missing.
Corrective Action(s): Ensure children's registration information is complete with all required documentation including emergency contacts and doctor's phone number.

Comments

Summary of Inspection:
At the inspection dated October 14, 2022, there were 10 children in attendance at the preschool. Licensing met with the manager. At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.
The following was discussed or education provided:
Changing the license to GCC 3-5 instead of preschool.
To include the repayment agreement on the registration form.
