Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance of (Licensing, Physical Facility, Staffing, Polices & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting).

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Licensing observed the Licence behind a photocopier machine on the counter in the kitchen area.

Corrective Action(s): Please ensure that the Licence is displayed in a prominent place in the community care facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Licensing observed the following that are accessible to children in care:
-Lysol wipes and spray bottle (with Vim and water mixture) in an unlocked cupboard below the sink in the kitchen area.
-3 big sized knives in an unlocked drawer in the kitchen area
Corrective Action(s): Please ensure that any hazardous objects and substances are not accessible to children in care.
Date to be Corrected: February 28, 2019.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing observed the water temperature in the kitchen sink to be at 50.1 degrees Celsius.
Corrective Action(s): Please ensure that heated water accessible to children in care is no more that 49 degrees Celsius.
Date to be Corrected: March 7, 2019.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon review of 2 staff records, Licensing observed that the staffs records were without any evidence that the 3 references had been checked.
Corrective Action(s): Please ensure that all staff records are complete.
Date to be Corrected: March 7, 2019.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon review of 2 staff records Licensing observed that 1 staff's record was without an immunization status.
Corrective Action(s): Please ensure that all staff records are complete.
Date to be Corrected: March 7, 2018.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: Licensing observed that the fire extinguisher was last serviced in 2017.
Corrective Action(s): Please ensure that a fire drill system is up to date and approved by a local assistant within the Fire Service Act.
Date to be Corrected: March 15, 2019.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that there was no documentation of fire drills for the months of March, April & May 2018.
Corrective Action(s): Please ensure that current records are kept for all emergency drills conducted.
Date to be Corrected: March 7, 2019.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon a random review of 7 days in the month of February, Licensing observed the following:
-6 days children not identified as present or absent.
-5 days children's time of arrival not indicated.
-1 day a child's time of departure not indicated.
Corrective Action(s): Please ensure that attendance records are accurate on a daily basis.
Date to be Corrected: March 1, 2019.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon a random review of 4 out of 8 children's records, Licensing observed 1 child's record without an emergency contact.
Corrective Action(s): Please ensure that all children's records are complete prior to the children attending the facility.

Comments

Summary of Inspection
At the routine inspection conducted today, February 28, 2019, there were 5 children and 1 staff present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Lead in water; flushing of water daily to ensure that there is no lead in the water.
· active supervision
· Licensing informed the Licensee that when reporting any reportable incidents to get in direct contact with a Licensing officer. If the Licensee's Licensing officer is unavailable then to call the Duty Line at (604) 587-3936.
