Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager is not posted.
Corrective Action(s): Ensure the name of the Manager is posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed in room 3:
-Paint chipping on the walls (this is a repeat contravention),
-mouse feces was observed under the boys bathroom sink,
-ants were observed coming in from the door to the playground.
Corrective Action(s): Ensure that a healthy and safe environment is provided. Please provide the written response of how you addressed the contraventions.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Floors, baseboards, doors, and shelves are visibly dirty. Room 3 bathrooms were observed dirty and in need of cleaning. The couches at the front of the facility are visibly dirty and the Manager confirmed that sometimes children use this area.
Corrective Action(s): Ensure that the furniture, equipment and fixtures are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11060 - CCLR s.14(2) - A licensee must have one toilet and wash basin for every 10 children or fewer.
Observation: The washroom in Room 1 was being used to store toys. This was identified at a previous routine inspection.
Corrective Action(s): Ensure that the toilet is available for use.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11140 - CCLR s.16(1)(a) - A licensee must have at least 6m² of outdoor play area for each child.
Observation: The outdoor play area does not measure to have all children in care outside at the same time. The Manager provided a plan after the last routine inspection to ensure that children were not outside at the same time or crossing between programs. The facility was not following the plan today. It was observed today that 43 children from 2 different service types were outside at the same time.
Corrective Action(s): Ensure that the plan put forward by the Manager is followed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: on the South West corner of the playground there is a gap between the wall and the chain link fence about foot wide. Currently there are logs and some broken planters and brambles located in this gap. There is a potential for a child to climb between the wall and the fence. A picture was taken and can be provided to the facility.
Corrective Action(s): Ensure that the play area is enclosed in a manner that is suitable to the age and development of the children.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Cleaning products were observed in an unlocked cupboard in the hallway kitchen.
Corrective Action(s): Ensure that cleaning products are not accessible to children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 3 of 7 employee files did not contain criminal record checks addressed to the facility. This is a repeat contravention
Corrective Action(s): Ensure that each employee has a criminal record check addressed to the facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 1 of 7 employee files reviewed did not contain references in respect to the person. This is a repeat contravention.
Corrective Action(s): Ensure each person has character references obtained.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: 1 of 7 employee files reviewed did not contain a record of the persons work history.
Corrective Action(s): Ensure that each person has a record of work history.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: 1 of 3 employee asked was not aware of the emergency plan. When inquired with the Manager, a different emergency location was described than that in the policy.
Corrective Action(s): Ensure that each employee is trained in the fire drill system and emergency plan.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: The facility did not have an Infant Toddler Educator (ITE) in Room 2. The ITE for room 1 is not scheduled to work daily. This is a repeat contravention.
Corrective Action(s): Ensure the ratio of employees to children is no less than schedule E. Please provide a staffing plan to the Licensing Officer.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: The nap bedding in room 3 was observed touching each other in the bags hanging and on the floor or nap beds on the floor. The Manager stated that it was set up from the day before.
Corrective Action(s): Ensure that bedding for each child is not touching another child's bedding.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: A child requiring medication did not have it available.
Corrective Action(s): Ensure that any medication agreed to be given to a child is readily available.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: One child did not have an emergency contact.
Corrective Action(s): Please ensure all children's records are current.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: 2 care plans have not been reviewed in the last year.
Corrective Action(s): Ensure that the care plan is reviewed annually.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: 2 care plans for children were unavailable for review.
Corrective Action(s): Ensure that each care plan is kept in a single location in the facility.

Comments

Summary of Inspection
At the inspection dated May 13, 2021 there were 43 children and 8 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer with actions taken on how the facility will come into compliance and maintain compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Discussed the importance of accurate records for non-reportable incident logs. It was discussed that a record of when the facility notified the parents should be kept.
· The advertising signs of the program are currently not correct with the facility name. The Manager was observed answer the phone with a different name "Educare". Please ensure that the advertising and facility name are the same.
· Discussed the importance of current photos to identify children being available for the staff both on site and off site. The facility has updated photos of the children on their application system, however in the emergency kits the photos appear to be when the children were much younger.
· There has been a change to the outdoor play area and it is not reflected on the site plans located in the facility files. Please provide an updated site plan with the layout and measurements of the outdoor area.
· Promoting Active Play in the program
· Active Supervision
