Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: During the inspection the name of the Manager was not posted.
Corrective Action(s): Please ensure the name of the Manager is prominantly displayed in the facility.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Two staff were observed working with the children in the facility. Licensing observed one certificate was posted but it was expired. Another staff certificate was not posted. In discussion with the staff one staff member stated she has renewed her certificate but it was not posted while another staff member stated she just received her certificate.
Corrective Action(s): Please ensure staff certificates for all of the staff working directly with the children are posted in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspetion licensing observed the following inside the facility:

-two tall shelves in the play area and the entrance way, were not secured to the wall. These could be a potential falling hazard.
-one plug covers were missing. This coud cause a potential electrocution hazard.
-a toilet brush was accessible to children in the washroom.

Licensing observed the following outside the facility:

- a shed with access to tools and a lawn mower was easily accessible to children
-the back steps were accessible to children. This could cause a potential falling hazard
-the climber was located on a concrete surface and there was no evidence of resilient ground covering that may cushion the impact of a fall. In discussion with the staff they stated that the climber was not in use. The climber was removed as there was snow on the playground. The staff stated that the climber is used on a grass surface.



Corrective Action(s): Please ensure a health and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11120 - CCLR s.15(2)(c) - A licensee must ensure that each piece of furniture or equipment for sleeping (c) is appropriate for the size, age and development of the children intended to use it.
Observation: Licensing observed a younger child being put to sleep in a car seat. In consultation with the staff they stated that they usually let the child spend an hour in the car seat and then they move him to a mat. The staff steted the child has difficulty sleeping on the mat. We discussed the importance of using age and developmentally appropriate furniture and equipment for sleeping as car seats are designed for use in a vehicle. Licensing made recommendations on alternate furniture and equipment that can be used by the children for sleeping.
Corrective Action(s): Please ensure age and developmentally appropriate equipment for sleeping is available for each child in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed a cleaning product under the sink in the washroom and miracle grow in the playground area. These chemicals were directly accessible to children. This could cause a potential poisoning hazard.
Corrective Action(s): Please ensure children do not have access to any object or substance that is hazardous to their health and safety.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: Licensing observed a fire extinguisher was located in the facility. The fire extinguisher was within the area of fully charged but no inspection tag was attached.
Corrective Action(s): Please ensure an inspection tag is attached to the fire extinguisher and there is documentation that shows the fire extinguisher is inspected on an annual basis.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The policies and procedures were reviewed. No policy was noted for active play or screen use.
Corrective Action(s): Please ensure an active play and screen use policy are developed, implemented and shared with the families.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: During the inspection the repayment policy was reviewed. A written statement outlining the refund of any prepayment such as post dated cheques is not written in the repayment policy.
Corrective Action(s): Please ensure the written repayment policy includes a statement that outlines the process for a refund when parents prepay the cost of services.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Licensing observed that there were no pictures of the children. The staff stated that when the staff take pictures they are immedicately deleted from their phones.
Corrective Action(s): Please ensure there is a photograph of each child that can be used to identify a child in an emergency.

Comments

At the inspection dated February 27, 2019 there were 7 children and 3 staff present and 1 Manager. At this inspection the above noted contraventions were identified. Please send a written response to Licensing by March 13, 2019 stating how you have addressed the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

Promoting Active Play in the program
Active Supervision
Lead in the Water
Creating one record to record fire drills, emergency evacuation and minor incidents
Adding diapers to the emergency kit.
