Introduction

An unscheduled routine inspection of this community care facility (CCF) was conducted by the licensing officer (FHA) to assess compliance w/ the:
• Community Care & Assisted Living Act (CCALA)
• Child Care Licensing Regulation (CCLR)
• Director of Licensing Standards of Practice (DLSP; Active Play & Safe Play Space)

At the time of inspection, evidence for this facility inspection report (FIR) was based upon:
• FHA's observations
• FHA's review of the CCF's records
• information provided to FHA by employees

FHA reviewed these 10 areas today:
• licensing • hygiene & communicable disease control
• physical facility • medication
• staffing • nutrition & food services
• policies & procedures • program
• care & supervision • records & reporting

As part of this inspection, FHA completed & provided a risk assessment tool, which includes:
• any noncompliance identified • the CCF's compliance & operational history since 26/Jan/2017

Contraventions
Previous Inspection - Contraventions observed on FIR #CGEE-AM9NZF have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name wasn't posted conspicuously.
Corrective Action(s): The licensee must ensure that the manager's name is posted conspicuously.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: FHA reviewed all 5 employees' files & found that 1 employee's CRC was from the Bby RCMP.
Corrective Action(s): The licensee must ensure that all employees' CRCs are from the BC Ministry of Justice's Criminal Records Review Prgm.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: FHA reviewed all 5 employees' files & found that 1 employee lacked 3 references.
Corrective Action(s): The licensee must ensure that all requirements of s. 19 are obtained by employees' 1st day of employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: FHA reviewed all 5 employees' files & found that 1 employee lacked a record of his work history.
Corrective Action(s): The licensee must ensure that all requirements of s. 19 are obtained by employees' 1st day of employment.

STAFFING: 12150 - CCLR s.19(4)(b) - A licensee must not employ a person in a community care facility as (b) a responsible adult unless the person has the qualifications required under Division 2 [Employee Qualifications].
Observation: FHA reviewed all 5 employees' files & found that 3 employees had no evidence 20 hrs of RA training. The manager stated that 2 employees don't have it & 1 employee may have it.
Corrective Action(s): The licensee must ensure that the minimum employee qualification requirement is met by employees' 1st day of employment. FHA discussed the possiblity of applying for an exemption to allow these employees to obtain their training over the next few mos whilst maintaining employment in the CCF.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The last fire drill system was implemented a year ago.
Corrective Action(s): The licensee must ensure that all employees implement the fire drill system monthly.

STAFFING: 12260 - CCLR s.29(c) - To qualify for employment in a community care facility as a responsible adult, a person must (c) have completed a course, or a combination of courses, of at least 20 hours duration in child development, guidance, health and safety, or nutrition.
Observation: FHA reviewed all 5 employees' files & found that 3 employees had no evidence 20 hrs of RA training. The manager stated that 2 employees don't have it & 1 employee may have it.
Corrective Action(s): The licensee must ensure that the minimum employee qualification requirement is met by employees' 1st day of employment. FHA discussed the possiblity of applying for an exemption to allow these employees to obtain their training over the next few mos whilst maintaining employment in the CCF.

STAFFING: 12470 - CCLR s.60(4) - Immediately after a person who was the subject of a character reference is no longer employed by or ordinarily present at the community care facility, a licensee must return all character references to the person, or destroy the character references.
Observation (CORRECTED DURING INSPECTION): A former employees' 3 references remained in her file.

POLICIES AND PROCEDURES: 13070 - CCLR s.56(1)(e) - A licensee must keep current records of each of the following: (e) written policies and procedures respecting food and drink to be given to children.
Observation: There are no written policies & procedures re. food & drink for children.
Corrective Action(s): The licensee must ensure that these policies & procedures are in place.

POLICIES AND PROCEDURES: 13080 - CCALA s.19 - If a person prepays part of the cost of services provided by a class of community care facilities designated by the Lieutenant Governor in Council, the licensee must, at the time of the prepayment, deliver to the person a written statement setting out the terms and conditions on which a refund of all or any of the prepayment will be made.
Observation: This financial information isn't provided to parents in writing.
Corrective Action(s): The licensee must ensure that this financial agreement is provided to parents in writing.

CARE AND/OR SUPERVISION: 14230 - CCLR s.51(1)(b) - A licensee must (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.
Observation: Parents aren't provided w/ the licensee's behavioural guidance policy.
Corrective Action(s): The licensee must provide parents w/ its behavioural guidance policy. FHA showed the manager "Guiding Children's Behaviour" (BC Govt, 2016), which supports the CCLR.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: This information isn't made available to parents.
Corrective Action(s): The licensee must make this information to parents. FHA & the manager discussed ways that this can be achieved.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: There's no repayment agreement in place.
Corrective Action(s): The licensee must create & keep a copy of the repayment agreement.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: There's no repayment agreement in place.
Corrective Action(s): The licensee must keep a record of those who've received the repayment agreement.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): FHA reviewed 7 children's files & found that 1 child lacked her start date.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation (CORRECTED DURING INSPECTION): FHA reviewed 7 children's files & found that 1 child lacked her end date.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: FHA reviewed the emergency consent cards & 4 new children lacked them. Children are driven to school & picked up from school.
Corrective Action(s): The licensee must ensure that medical/emergency consent is maintained @ all times.

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: The last annual outdoor playspace inspection was conducted in 2014. The manager stated that the outdoor play space is inspected daily but not always documented (it was last documented during the 2nd wk of Jun/2018).
Corrective Action(s): The licensee must ensure that inspections (daily/monthly/annual), maintenance, & repairs are documented.
