Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Manager's name was not posted in the facility.
Corrective Action(s): A licensee must display in a prominent place the name of the manager.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): During inspection licensing observed electric cords of a CD player were accessible to children in the play area.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 3 staff records and 2 staff's certificate has not been validated.

Corrective Action(s): Please ensure that an educator or an assistant holding a certificate issued under Division 2; must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that there were not sufficient supplies in the emergency bag to recover from an emergency. Licensing provided education that there needs to be sufficient items in the emergency bag for 72 hours for all the children and staff attending the facility.
Corrective Action(s): Please ensure that there is an emergency plan in place that sets out procedures to prepare for, mitigate, respond and recover from any emergency for all the children in care.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: 6 out of 10 children's files reviewed did not contain date of enrolment.
Corrective Action(s): Please ensure that date of enrolment is recorded for each child.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation: One child’ file was missing written instructions on medication that child takes daily at the facility.Staff were abe to explain the instructions verbally.
Corrective Action(s): Ensure that child’s records include special instruction regarding the child's medication given by the child's parent to the licensee in writing.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation (CORRECTED DURING INSPECTION): One child’s records was unavailable at the facility. Child’s file was brought from another facility during the inspection.
Corrective Action(s): Children’s records must be kept at a single location at the facility.

Comments

At the inspection dated June 25, 2021 there were twelve children and three staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following were discussed with the manager:
· Bottles of cleaning solution must be clearly labelled with the contents.
· Staff records to be available for the staff working at the facility.
The following resources were provided and discussed:

· Bulletin-Care Plan
· Bulletin-Children’s Records
· Bulletin-Water Safety
· Bulletin- Summer Safety

The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on June 28, 2021. Total time includes writing report in office.
