Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All eight care categories were assessed for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the manager's name was not posted.
Corrective Action(s): Ensure the manager's name is posted at the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing observed that one staff member's criminal record check was not site specific.
Corrective Action(s): Ensure a site specific criminal record check is obtained for employees before the start of employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one employee.
Corrective Action(s): Ensure employees' record of work history is obtained before the start of their employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing inspected three staff certificates and could not find evidence of verification.
Corrective Action(s): Ensure staff certificates are verified using the system maintained by the early childhood educator registry.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensing observed that a fire drill had not been conducted in June 2021.
Corrective Action(s): Ensure that each employee practices implementing the fire drill system at least once each month.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Licensing could not find a record of implementation of the emergency plan the year 2020. A clarifying conversation with the manager indicated that the implementation of the emergency plan did not take place for 2020.
Corrective Action(s): Ensure that emergency plan is implemented at least once each year.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: A minor incident log could not be produced at time of inspection.
Corrective Action(s): Ensure a log of minor accidents, illness and unexpected event involving children is kept.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed arrival/departure times are not noted as part of facility's attendance records.
Corrective Action(s): Ensure that a daily record is kept indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.

Comments

Summary of Inspection:
At the inspection dated September 15, 2021, there were 13 children in care with 3 educators including the Manager.
A COVID-19 Risk Screening was conducted before the inspection.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.
This report was written off site due to COVID-19 safety practices. The contraventions identified in the report were reviewed with the Manager before Licensing's departure.
A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-Communicable disease prevention practices.
-Maintaining staff record and certificates in a way that preserves their integrity.
-Systems to ensure facility emergency supplies are refreshed as required.
