Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Community Care Facility License was not displayed in the facility.
Corrective Action(s): Ensure the license is prominently posted in the facility.
Date to be Corrected: November 4, 2022

STAFFING: 12010 - CCALA s.7(1)(d) - A licensee must do all of the following: (d) appoint a manager for the community care facility.
Observation: Licensing noted a manager's name posted, however, Licensing has not received the paperwork requesting a change in Manager.
Corrective Action(s): Ensure Licensing has received notice of a change in Manager.
Date to be Corrected: November 4, 2022

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A random selection of staff files were reviewed. Out of the 5 reviewed, 1 did not have a site specific criminal record check and another 1 had an expired criminal record check from August 2022.
Corrective Action(s): Ensure a current and valid criminal record check has been obtained and is on file.
Date to be Corrected: November 4, 2022

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A random selection of staff files were reviewed. Out of the 5 reviewed, 2 files did not contain any record that the references were checked prior to working with children. This is noted to be a repeat contravention.
Corrective Action(s): Ensure there is a record of character references on file.

PROGRAM: 18020 - CCLR s.44(1)(b) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (b) is appropriate for the age and development of children in each group in the community care facility.
Observation: Licensing observed the following:
- Upon Licensing's arrival at the facility there were 4 children in care and no activities or equipment set up for the children. As more children arrived they were asked to find something to do, however the children were not provided with any toys or equipment. The staff reported the children choose to just hangout in their groups and don't want to do the activities the facility provides.
- In classroom 1 lego available on the floor, a small foosball table top toy which appeared broken and some paper and coloring utensils
- In classroom 2 there was a large cardboard box used as a fort, paw patrol car ramp, some lego and board games located on a high shelf
- All tables were empty

This is noted to be a repeat contravention.
Corrective Action(s): Ensure the facility provides a program that is age and developmentally appropriate for the group.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: A random selection of children's files were reviewed. Out of the 4 reviewed, 2 files did not contain the date of enrolment. This is noted to be a repeat contravention.
Corrective Action(s): Ensure there is a record showing the date of enrolment.

Comments

Summary of Inspection:
At the inspection dated October 28, 2022, there were 9 children in care with a staff.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by November 4, 2022 .
Actions required by Licensing include reviewing the written response.

The following education was provided:
Covid-19 vaccine status for staff
Licensing reviewed the minor incident log book and while there was good documentation in there, more information was required for some incidents. Discussion was had with the staff to ensure the 5 W's (who, what, where, when, why sometimes how) are included when documenting.
First Aid Kits requires replenishing

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report. The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.
