Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the 2 sofas in the OSC Program had large rips/openings, 1 opening was stuffed with a plastic bag filled with cotton. Manager stated that they will repair or replace them.
Licensing observed that the ceiling in the bathroom had an exposed area, Manager stated that in the winter the roof was leaking and the worker exposed the area of the ceiling to inspect the leak. The roof was temporarily fixed and it will be replaced by a new roof. The Manager will have someone repair the exposed ceiling.
Corrective Action(s): Please ensure that furniture, equipment and fixtures are clean and in good repair while children are in attendance

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 5 staff files and noted that 2 were missing references, 1 file had 1 reference and the other had 2 references, best practice is to obtain 3 references per staff.
Corrective Action(s): Please ensure that character references are obtained in respect to the person.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Licensing reviewed 5 staff files and noted that 1 staff's certificate was expired October 2020, Manager has asked the staff to provide a copy of the new certificate as the staff was off work and returned to work last week.
Corrective Action(s): Please ensure that you obtain copies of any diplomas, certificates or other evidence of the person's training and skills.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 5 Staff files and noted 2 were missing validation of their certificates. 1 was corrected on site.
Corrective Action(s): Please ensure that a system is in place to verify staffs certificates.

Comments

Summary of Inspection
At the inspection dated May 26, 2021 there were 12 children and 3 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:

Discussion was had with the Manager to ensure that 2 of the carpets in the 30 months to School age do not pose a tripping hazard to the children. Manager will turn them around to place the curled edges under the shelves, until they can be replaced.

Discussion with the Manager to communicate with parents to ensure that expired medication is replaced.

Ensuring appropriate use of the logbook.

Ensuring a system is in place to record fire drills for both programs if done together as a large group.

Manager shared with Licensing that they are moving to a digital filing system and ensuring that all staff have access to these digital files.

Ensuring a system is in place to check character references.
