Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing noted the resilient surfacing in the 3-5 and infant/toddler playground is showing signs of wear and tear. The current mats used are loosing it's resiliency and poses a risk of injury to a child.
Corrective Action(s): Ensure all furniture, equipment and fixtures are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation (CORRECTED DURING INSPECTION): Licensing observed the hot water to be at 53 degrees celsius. The licensee turned off the hot water.
Corrective Action(s): Ensure heated water is no more than 49 degrees celsius.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): A selection of staff files were reviewed. One file did not contain a criminal record check. The Licensee stated a criminal record check was completed recently and a copy would be provided to Licensing.
Corrective Action(s): Ensure all employees have obtained a valid criminal record check.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Immunization status was not obtained for one employee.
Corrective Action(s): Ensure immunization status is on file for all employees. The licensee contact put a note confirming the immunization status of the staff.

Summary of Inspection:
At the inspection dated March 8, 2022 there were 29 children in care with 6 staff and the Licensee contact.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by March 15, 2022 .
Actions required by Licensing include reviewing the written response.

The following education was provided:
Covid-19 vaccine status for staff

This report was written off site and a copy of both the report and Risk Assessment was emailed to the facility. This report is unsigned due to health and safety practices during COVID-19.
