Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following items were found to be in disrepair:
-nap mats- over half had torn corners, which makes it difficult to sanitize
-one light cover was cracked and sagging
The following requires cleaning or attending to:
-bathroom floors
- a potty seat was stored with the seat part touching the floor by the toilet
Corrective Action(s): Please ensure all areas and fixtures within the facility are clean and in good repair
Date to be Corrected: June 27, 2019.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Five staff files were reviewed and one staff had an expired Criminal Record check from December 2018. Manager stated that a new Criminal Record Check would be applied for immediately.
Corrective Action(s): Ensure each staff has a current criminal record check from the criminal records review in Victoria.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: The following was observed while on site:
-1 child has expired permission for giving medication
-1 child had expired medication
-although updated, 1 care plan was missing a parent signature
-1 care plan was expired and the medication was expired
Staff messaged parents while Licensing was on site to request medications and forms to be updated.
Corrective Action(s): Please ensure that medication and care plans are reviewed yearly to ensure that medication is administered to the child in the amount and times specified by the parent or in the child's care plan.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Two weeks of attendance were reviewed and 8 departure times were missing for various children.
Corrective Action(s): Please ensure that departure time is recorded daily for each child in attendance.

Summary of Inspection
At the inspection dated June 13, 2019 there were 17 children and 3 staff present. At this inspection the above noted contraventions were identified.
